AN ORDINANCE RECLASSIFYING CERTAIN PROPERTY LOCATED AT 1080 EAST CHICAGO STREET ELGIN, ILLINOIS WHEREAS, written application has been made to reclassify certain property located at 1080 East Chicago Street from R-1, Single-Family Residence District, to B-4, General Service District; and WHEREAS, the Land Use Committee has conducted a public hearing after due notice and submitted its report and recommendations to the City Council; and WHEREAS, the City Council has reviewed the recommendations of the Land Use Committee and concurs in such recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS:' Section 1. That Chapter 19.08, Section 19.08.020, entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinbefore laid out in the 'Zoning District Map' , as amended, be and are hereby altered by excluding from R-1, Single-Family Residence District, and including in B-4, General Service District, the following described property: That part of the southeast quarter of Section 18, Town- ship 41 North, Range 9 East of the Third Principal Meridian, bounded and described as follows: Commencing at the intersection of the southerly line of Kings Lane Subdivision and the easterly line of the Second Addition to Highview Hills; Thence southerly along said easterly line of Second Addition to Highview Hills and said easterly line extended southerly a distance of 605.65 feet to the true point of beginning; Thence easterly at right angles to the previously described line a distance of 397.5 feet more or less to a point on the westerly line of Ceresa Drive; Thence southerly along the westerly line of Ceresa Drive and westerly line extended southerly, a distance of 572.0 feet more or less to the center line of the Chicago-Elgin Road; Thence northwesterly along said center line of the Chicago-Elgin Road a distance of 408.70 feet to the easterly line of the Second Addition to Highview Hills extended southerly; Thence northerly along said easterly line of the Second Addition to Highview Hills and said line extended southerly, a distance of 480.00 feet to the point of beginning. In Cook County, Illinois." subject to the following conditions determined necessary to protect the public health, safety and welfare: 1. That no occupancy permit shall issue for any newly constructed structure prior to the removal of existing structures. 2. Ceresa Drive shall be realigned and additional right of way dedicated in the event that said condition is necessary and desirable for the improvement of State Route 19 by the State of Illinois. Section 2. That this ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law and shall be published in pamphlet form by order of the City Council. s/ Richard L.
