AN ORDINANCE
RECLASSIFYING CERTAIN PROPERTY AND GRiNTING A SPECIAL USE
FOR OFF-STREET PARKING
WHEREAS, written application has been made to reclassify certain
property located at 72 North Alfred Street from R-4, General Residence
District, to B-1, Community Business District, and to reclassify 69 and
81 North Aldine Street from B-1, Community Business District, to R-4,
General Residence District, and for a special use for off-street parking
on the premises located at the south and extending to the rear of 86 North
Alfred Street; and
WHEREAS, the Land Use Commission has conducted a public hearing after
due notice and submitted its report and recommendations to the City Council;
and
WHEREAS, subject property heretofore was the subject of a petition for
similar reclassification which was granted; and
WHEREAS, the ordinance granting the reclassification inadvertently omitted
certain property and failed to include the special use requested.
NC (, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That Chapter 19.08, Section 19.08.020, entitled "Zoning
District" of the Elgin Municipal Code, 1976, as amended, be and the same
is hereby further amended by adding thereto the following paragraph:
"The boundaries hereinbefore laid out in the 'Zoning
District Map' , as amended, be and are hereby altered by
excluding from R-4, General Residence District, and including
in B-1, Community Business District, the following described
property:
The southerly 100 feet of Lot 17, and the northerly
14 feet of Lot 18, Block 3 of T. F. swan's Addition to the
City of Elgin, Kane County, Illinois."
Section 2. That Chapter 19.08, Section 19.08.020, entitled "Zoning
District" of the Elgin Municipal Code, 1976, as amended, be and the same
is hereby further amended by adding thereto the following paragraph:
"The boundaries hereinbefore laid out in the 'Zoning
District Map', as amended, be and are hereby altered by
excluding from B-1, Community Business District, and including
in R-4, General Residence District, the following described
property:
The westerly 165.0 feet of Lots 8, 9 and 10, Block 1
of the Pleasant Home Addition to the City of Elgin, Kane
County, Illinois."
Section 3. That a special use be and is hereby granted for off-street
parking on the premises located immediately south and extending to the rear
of 86 North Alfred Street and legally described as follows:
The easterly 60.0 feet of Lot 11, Block 1, Pleasant Home
Addition and the northerly 14.0 feet of Lot 17, Block 3 of
T. F. Swan's Addition to the City of Elgin, Kane County,
Illinois.
Section 4. The City Council hereby finds that the special use herein
granted has been in use since 1968 and provides necessary off-street parking
at that location which is in the public interest, and is so designed, located
and operated that the public health, safety and welfare has been protected
and that such use has not caused substantial injury to the value of other
property in the neighborhood in which it is located and that such conditions
shall continue in the future.
Section 5. That this ordinance shall be in full force and effect from
and after its passage and approval in the manner provided by law.
