HomeMy WebLinkAboutG1-77 Ordinance No. G1-77 AN ORDINANCE VACATING A PUBLIC ALLEY AND PUBLIC EASEMENT BETWEEN CENTER STREET AND NORTH SPRING STREET WHEREAS, the public interest will be served by vacating a public alley and public easement in P. J. Kimball Jr's. Second Addition in the City of Elgin, Kane County, Illinois; and WHEREAS, said property is not necessary to serve the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That a public alley and public easement in P. J. Kimball Jr's. Second Addition in the City of Elgin, Kane County, Illinois, legally described as follows: The 16. 5 foot wide Public Alley lying East of the East line of North Spring Street, West of the West line of Center Street, South of and adjacent to the South line of Lots 20 through 24, both inclusive and North of and adjacent to the North line of Reserved Lot 46, all as platted in P. J. Kimball Jr's. Second Addition to Elgin, in the City of Elgin, Kane County, Illinois. ALSO an 8.0 foot wide Public Easement lying East of and adjacent to the East line of Lots B and C, North of the South line extended East of said Lot B and South of the North line extended East of said Lot C, all as platted in the Assessors Subdivision of Reserved Lots 46 and 47 in P. J. Kimball Jr's. Second Addition to Elgin, in the City of Elgin, Kane County, Illinois. be and the same is hereby vacated. Section 2. That the City of Elgin does hereby reserve to itself and to any public utility company owning any public service for facilities in, upon or under said right of way vacated by this ordinance full right of access for the purpose of continuing or extending any public service facilities and to maintain, renew, extend or construct or reconstruct any such public service facilities. Section 3. That a certified copy of this ordinance together with a plat of said vacated right of way be filed with the Recorder of Deeds of Kane County, Illinois. Section 4.
