That a local improvement shall be made in the City of Elgin, Kane County, Illinois, the nature, character, locality and description of which improvement is as follows: A system of Sanitary Sewers, together with 1,440.00 all necessary appurtenances in Big Timber Road, Hillcrest Road, Meadow Lane, Oakdale Drive, Parkview Drive, Prairie Drive, Green Acres Court, Pleasant Drive, Forest Drive, Century Oaks Drive, Pleasant View Court, Morningside 1,491.00 Drive and Morningside Court, to be known as the "Special Assessment District, proposed Sanitary Sewer for Century Oaks and Morningside Estates Subdivision." The proposed connection system of sanitary sewers shall be constructed in. manner and in all respects as shown on the detailed plans and profiles, an provided in the specifications for this improvement hereto attached and by reference made a part hereof, and all of the same shall be read and const in connection with this resolution to make the whole complete and consisten, All reference herein to plans shall be construed to mean such plans as are hereto attached consisting of nineteen (19) sheets of plans. All reference to specifications shall be construed to mean specifications as are hereto All such plans and specifications, including every line, letter and figure thereon describing said improvement, are hereby made a part of this resolu though said plans, specifications, lines, letters and figures were describ set forth herein. Where there appears to be a variance between the plans; fications and description in the resolution, the plans shall govern and tt variance in the specifications and description in the resolution shall be regarded. The term "Datum" as used herein refers to the datum plane. Each such station is numbered with a amber corresponding numerically to the distance in hundreds of feet along the line of the improvement from the respective stations to a definitely fixed initial: point designated as Station 0. Intermediate points between stations are indicated by numbers preceded by plus signs. Each such number corresponding numerically to the distance in feet along the line of the improvement from the indicated point to the last preceding station. Where such a plus sign and number are used in connection with and following a given station to describe a location, the distance in feet as indicated by the number shall be added to the distance in hundreds of feet as indicated by the station to give the total distance of a described location from Station 0. Any such distance so indicated shall be measured along the center line of the sewer, and shall refer to a definitely fixed point in said center line and to all points in a line drawn perpendicular to said center line through such definitely fixed point. Wherever the term "sewer line" is referred to herein, it shall mean a line coinciding with the longitudinal center line of the sewer. Wherever a distance in the direction of the length of a section of sewer is given herein, said distance shall be construed to mean a distance measured along the center line of said sewer or its extension. The word "street" shall be taken to include streets, avenues, courts, roads and places. Wherever distance between parallel lines.is given herein it shall be construed to mean a distance measured along a line perpendicular to such parallel lines and unless specified where a distance between a point and a line is given herein, it shall be construed to mean a distance measured along a line perpendicular to such given line. The construction of the proposed improvement as herein set forth shall consist of the following: All sewers and stubs shall be constructed of the best quality material of the size and at the location shown on the plans and as provided in the specifications. Wherever the size of a sewer is referred to herein, it means the internal diameter of such sewer in inches. In constructing the sanitary sewer pipe herein provided for, the sections Of pipe shall be laid true to the line and grade shown on the plans with the spigot ends towards the outlet of the sewer. The pipe shall be laid and the joints made water tight in a manner provided in the specifications. "T"' junction fittings shall be provided for in the sanitary sewer for the future connection of 6 -inch house drains for each platted lot abutting the improvement. In construction of the sanitary sewer stubs herein provided for, the sections Of pipe shall be laid true to the line and grade shown on the plans with the spigot ends towards the outlet of the sewer. The pipe shall be laid and the joints made water tight in a manner provided in the specifications. In constructing the sewers and stubs herein provided, the sewer tren shall be kept free from water and where necessary, the sides thereof secured in place by sheeting or shoring. The manholes shall be of the kind, shape and size and shall be locat shown on the plans. Each manhole shall be placed and constructed ce over the center line of the sewer and in case of the center line of sewers connecting or intersecting, then centrally over said connecti intersection. All sewers shall be constructed with a water tight co through the masonry walls of the manholes to and from which they are and all inlets and outlets in the manholes shall be flush with the i surface of the walls of the manholes. Manholes shall be constructed of highest quality brick masonry or concrete masonry units laid in a mortar bed composed of one part portland cement to three parts sand, by volume, based on dry materials. Each manhole shall be fitted with a cast iron frame and cover and with steps of the size, shape, kind and quality as shown in the plans and as vided in the specifications. All concrete used in connection with this improvement shall meet the ments for monolithic concrete as specified. All trenches for sewers and stubs or excavations around structures shall6 backfilled with suitable earth up to the original surface of the ground, backfilling shall be done in such a manner as to prevent after settlement, After the backfilling has been completed as above specified, all surplus material, earth, rubbish and other debris shall be removed. After trenches and excavations have been backfilled as heretofore specifk the surface of the driveways shall be scarified and the surplus material removed. The sub -base of the driveways shall then be thoroughly compacted to the lines and grades established by the Engineer and the driveways, inc ing gravel base and bituminous surface where required, shall be replaced carefully and thoroughly as specified. All existing structures along the lines of the improvement, including water and pipes, electric conduits, sewers and drains, poles carrying telephone, telegro electric light and power lanes, railroad tracks, pavement, sidewalks, curbs,fe culverts or other structures of any kind met with during the prosecution of the work, shall be protected against damage resulting from the making of this impro ment and where damaged, all such structures shall be restored to as good a cond as that existing prior to the commencement of this work. The sewers herein provided to be constructed shall be connected to and shall into manholes to be constructed or are constructed and shown on plans as exi manholes. All of the above described improvements shall be constructed under the direct vision and to the satisfaction of the Board of Local Improvements of the City Elgin, Illinois, and all the necessary labor and work shall be performed in a and workmanlike manner. Section 5. That for the purpose of anticipating the collection of the second and succeeding installments of said assessment for the cost of said improvements, the CITY OF ELGIN shall issue bonds payable out of said installments, bearing interest at the rate of seven per cent (7%) per annum, being the rate now per- mitted by law, signed by the Mayor of the CITY OF ELGIN, and attested to by the City Clerk of said City. Said bonds shall be issued in accordance with and shall in all respects conform to the provisions of the Illinois Municipal Code, Article 9, Division 2, and amendments thereto. Section 6. That the Mayor of the CITY OF ELGIN, be, and he is hereby directed to file a Petition in the Circuit Court of Kane County, Illinois, praying that steps may be taken to ascertain the just compensation to be made for private property taken or damaged and easements to be acquired for the said improvements and to ascertain what property will be benefited by said improvement and the amount of such benefit, and also that steps be taken to levy a special assessment for said improvement; in accordance with the provisions of this Ordinance, and in the manner Prescribed by law. Section 7. That all ordinances, or parts of ordinances, in conflict with this ordinance, be, and the same are hereby repealed. Section 8.
