AN ORDINANCE
AMENDING THE ELGIN ZONING ORDINANCE RECLASSIFYING CERTAIN PROPERTY
LOCATED AT 1881 LARKIN AVENUE AND GRANTING A SPECIAL USE
FOR AN OPEN SALES LOT
WHEREAS, written application has been made to reclassify certain property
located at 1881 Larkin Avenue from B-3, Service Business District, to B-4,
General Service District, and for a special use for an open sales lot; and
WHEREAS, the Plan Commission has reviewed said application and submitted
its report to the Zoning Board of Appeals and to the City Council; and
WHEREAS, the Zoning Board of Appeals has conducted a public hearing after
due notice and submitted its report and recommendations to the City Council;
and
WHEREAS, the City Council has reviewed the findings and recommendations of
the Plan Commission and the Zoning Board of Appeals.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That Subsection B of Section 21-106 of Chapter 21 of the
City Code of Elgin, Illinois, as amended, be and the same is hereby further
amended by adding thereto the following paragraph:
"The boundaries hereinbefore laid out in the 'Zoning District
Map' , as amended, be and are hereby altered by excluding from B-3,
Service Business District, and including in B-4, General Service
District, the following described property:
Lots 1, 2 and 3 except the south 50 feet of said Lots 1,
2 and 3, Map 4, Fox River Hills, in the City of Elgin, Kane
County, Illinois, commonly known as 1881 Larkin Avenue."
Section 2. That a special use for an open sales lot for use as a rental
agency on property described in Section 1, be and is hereby granted subject
to the following:
1. That the site be developed so as to preserve existing plant
material and that additional screening be added as the storage area
expands;
2. That the signage shall conform to the proposed sign ordinance;
and
3. That in the event that petitioner should abandon the special
use granted, City of Elgin may proceed to reclassify the subject
property without objection by petitioner.
Section 3. That this ordinance shall be in full force and effect from and
after its passage and approval in the manner provided by law and shall be
published in pamphlet form by order of the City Council.
