AN ORDINANCE
ADOPTING THE ELGIN MUNICIPAL CODE, 1976
WHEREAS, the Book Publishing Company, Seattle, Washington, has compiled,
edited and published a recodification of the permanent and general ordinances
of the City of Elgin, Illinois; and
WHEREAS, it is necessary and desirable to adopt said recodification.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That there is hereby adopted the "Elgin Municipal Code, 1976"
as compiled, edited and published by Book Publishing Company, Seattle, Washing-
ton, a copy of which is attached hereto and made a part hereof by reference as
Exhibit 'A' , as the municipal code of the City of Elgin.
Section 2. The "Elgin Municipal Code, 1976," shall be referred to in any
prosecution for the violation of any provisions thereof or any proceeding at
law or in equity. It shall be sufficient to designate any ordinance, adding
to, amending, correcting or repealing all or any part or portion thereof as an
addition to, amendment, correction or repeal of the "Elgin Municipal Code,
1976." Further reference made be had to the titles, chapters, sections and
subsections of the "Elgin Municipal Code, 1976" and such references shall apply
to the numbered title, chapter, section or subsection as it appears in the code.
Section 3. That the last ordinance of the City of Elgin included in the
"Elgin Municipal Code, 1976," attached as Exhibit 'A' is Ordinance G4-76, passed
January 14, 1976. The following ordinances, passed subsequently to G4-76, but
prior to the adoption of the "Elgin Municipal Code, 1976," be and are hereby
adopted and made a part of the "Elgin Municipal Code, 1976":
Ordinance G6-76 entitled, An Ordinance Prohibiting Parking.on
Brook Street, West Side, from Water Street to North Street, passed
January 28, 1976.
Ordinance G9-76 entitled, An Ordinance Establishing Fees for
Permits and Inspections, passed January 28, 1976.
Ordinance G11-76 entitled, An Ordinance Prohibiting Parking in
the Civic Center Official Parking Lot, passed February 11, 1976.
Ordinance G14-76 entitled, An Ordinance Providing for Permits
for Sidewalk and Street Vault Spaces, passed March 10, 1976.
Ordinance G15-76 entitled, "An Ordinance Amending the Provisions
for the Administration of the Elgin Zoning Ordinance, passed March 10,
1976.
Ordinance G16-76 entitled, An Ordinance Establishing the Elgin
Emergency Service and Disaster Agency, passed March 24, 1976.
Ordinance G17-76 entitled, An Ordinance Establishing the
Planning and Land Use Commission, passed March 24, 1976.
Ordinance G18-76 entitled, An Ordinance Amending the Bicycle
Registration Provisions of the Elgin City Code, passed March 24,
1976.
Ordinance G19-76 entitled, An Ordinance Increasing the
Authorized Strength of the Police Department, passed April 14, 1976.
Ordinance G20-76 entitled, An Ordinance Amending the Elgin
Fair Housing Ordinance to Delete the Requirement of a Filing Fee,
passed April 14, 1976.
Ordinance G21-76 entitled, An Ordinance Amending the Off-Street
Parking Provisions of the Elgin Zoning Ordinance, passed April 14,
1976.
Ordinance G22-76 entitled, An Ordinance Providing for the Regula-
tion fo the Sale of Alcoholic Liquors at Retail, passed April 28, 1976.
Ordinance G19-76 entitled, An Ordinance Regulating the Subdivision
and Development of Land Within the City of Elgin, passed April 28, 1976.
Ordinance G25-76 entitled, An Ordinance Prohibiting Parking on
Portions of Davis Road and Holmes Road in the City of Elgin, Illinois,
passed May 12, 1976.
Ordinance G26-76 entitled, An Ordinance Amending the Schedule of
Fees for Permits and Inspections, passed May 12, 1976.

Metered Parking on the West Side of South State Street, passed
September 8, 1976.
Ordinance G41-76 entitled, An Ordinance Amending the Zoning Ordinance
of the City of Elgin and Otherwise Regulating the Use of Signs by Adding
Section 21-111 Entitled "Community Graphics", passed September 22, 1976.
Section 4. That whenever a reference is made to the "Elgin Municipal Code,
1976," or to any portion thereof, or to any ordinance of the City of Elgin,
Illinois, the reference shall apply to all amendments, corrections, additions
heretofore, now, or hereafter made.
rSection 5. Title, chapter and section headings contained in the "Elgin
E Municipal Code, 1976," shall not be deemed to govern, limit, modify, or in
any manner affect the scope, meaning, or intent of the provisions of any
title, chapter or section of the code.
Section 6. The provisions of the "Elgin Municipal Code, 1976," shall
not in any manner affect matters of record which refer to, or are otherwise
related to ordinances which are therein specifically designated by number or
otherwise and which are included within the "Elgin Municipal Code, 1976,"
but such references shall be construed to apply to the corresponding provi-
sions contained in the code.
Section 7. Neither the adoption of the "Elgin Municipal Code, 1976,"
shall in any manner affect the prosecution for violations of ordinances
committed prior to the effective date of this ordinance, nor shall it be
construed as a waiver of any license, fee or penalty which upon the effective
date of this ordinance is due or unpaid, nor shall it be construed as affect-
ing the provisions of any ordinance relating to the collection of any license,
fee or penalty or the penal provisions applicable to any violation thereof,
nor to affect the validity of any bond, fine or deposit, and all rights and
obligations thereunder shall continue in full force and effect.
Section 8. If any section, subsection, sentence, clause or phrase of
the Elgin Municipal Code, 1976, is for any reason held to be invalid or
unconstitutional, such decision shall not affect the validity of the remaining
portions of the code.
Section 9. That this ordinance shall be in full force and effect from
and after November 1, 1976 and shall be published in pamphlet form by authority
of the City Council of the City of Elgin, Illinois.
