HomeMy WebLinkAboutG40-76 Ordinance No, G40-76 AN ORDINANCE AMENDING AN ORDINANCE GRANTING A FRANCHISE TO CONSOLIDATED CABLE UTILITIES, INC. BY INCREASING THE MONTHLY RATE FOR SERVICE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Subsection d of Section 6 of Ordinance No. S-935 passed December 10, 1969 entitled "An Ordinance Granting Authorization to Consolidated Cable Utilities, Inc. , to Construct, Operate and Maintain a Community Antenna Television System in the City of Elgin" be and is hereby amended to read as follows: "d. Operator agrees that all rates charged its subscribers to its service shall be standard, uniform and reasonable; a copy of the Operator's scale of charges for installation and furnish- ing of service shall be filed with the City Clerk not less than 60 days prior to the effective date of such charges. The scale of rates and charges and any amendments thereto shall be subject to the approval of the City Council. The monthly rate to sub- scribers shall not exceed $7.00 per month for the first outlet and shall not exceed $1. 25 per month next outlet and shall not exceed $.75 for each additional outlet. The installation charge shall not exceed $15.00 for the first outlet or $3.00 for each additional outlet. The operator agrees that when subscriber saturation in the City reaches 75%, there will be a 5% reduction in rates for all subscribers in the City. When 90% saturation is reached, there will be an additional 5% reduction in rates for all subscribers in the City. The term "saturation" shall mean 80% of the potential subscribers in the City are receiving service. Operator hereby agrees that no free services will be permitted to any customer provided, however, that this provision shall not prevent Operator from conducting promotional campaigns to attract new customers, including elimination or reduction of the initial connection fee or of the monthly service charge for a specified period." Section 2. That all ordinances or parts of ordinances in conflict with this ordinance be and are hereby repealed. Section 3.
