HomeMy WebLinkAboutG310-76 Sidewalk Vault Spaces (a310-qb AN ORDINANCE PROVIDING FOR PERMITS FOR SIDEWALK AND STREET VAULT SPACES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Section 20-613 of Chapter 20 of the Municipal Code of Elgin, as amended, be and is hereby amended to read as follows: "20-613. TERM OF PERMIT. Permits issued under the provisions of this article shall be for a period of one (1) year; however, permits may be issued for periods not to exceed ten (10) years upon approval of the City Council. Any person desiring to use any vault space, room, or structure under any street or sidewalk of the City of Elgin, in existence as of September 1, 1974 and who obtained a permit therefor by December 1, 1974, may apply for a permit for a period not to exceed ten (10) years. Such person shall make applica- tion to the City Council of the City of Elgin setting forth the reasons for the request for an extended permit and fully describe any improvements to the vault space in question, and setting forth the reasons why it is necessary to obtain a permit for a period longer than one (1) year's duration. The City Council may grant such application if it finds that the continued use of the vault is necessary for the continued productive use of the building which the vault space serves, that there are practical difficulties or particular hardships imposed by the grant of a permit for one (1) year, and that the particular physical surroundings, shape or other conditions of the specific property involved require utilization of the vault space. Any such permit issued for a period in excess of one (1) year shall be conditioned upon the payment of the permit fee for the full term, the filing of annual certificates of insurance, and annual inspection by the City of Elgin." Section 2. That this ordinance shall be in full force and effect from and after its passage in the manner provided by law. Richard L. Jentsch, Corporation Counsel SUBJECT: Application for Ten Year Vault Permit Attached is the application of the First National Bank of Elgin as trustee under Spiess/Penny's Trust No. 1068 for a ten year vault permit to serve the J. C. Penny store. You will recall that the ordinance was recently amended to permit ten year permits upon application to the City Council. A copy of that ordinance is also attached. Erwin W.
