AN ORDINANCE
RECLASSIFYING CERTAIN PROPERTY AT 59/61 KIMBALL STREET FROM
B-4 TO B-1 WITH A SPECIAL USE FOR A CHURCH
WHEREAS, written application has been made for the reclassifying of
certain property located in the City of Elgin and commonly known as 59/61
Kimball Street, Elgin, Illinois, from B-4, General Service Business
District, to B-1, Community Business District, with a special use for a
church; and
WHEREAS, the Land Use Committee conducted a public hearing on said
application following due notice as required by law; and
WHEREAS, the Land Use Committee has recommended approval of the
application; and
WHEREAS, the City Council concurs in the recommendations of the Land
Use Committee.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That Subsection B of Section 21-106 of Chapter 21 of
the zoning ordinance of the City of Elgin, Illinois, as amended, be and
is hereby further amended by adding the following paragraph:
"That the boundaries hereinbefore described in the
'Zoning District Map' as amended, be further amended by
excluding from the B-4, General Service Business District,
and including in the B-1, Community Business District, the
following described property:
Lot 64 of Phineas J. Kimball Jr's. Second Addition to
Elgin, in the City of Elgin, Kane County, Illinois."
commonly known as 59/61 Kimball Street.
Section 2. That the City Council of the City of Elgin finds that
the granting of a special use for a church on the subject premises is
necessary for the public convenience at the proposed location to serve
the members of the congregation of said church;
The City Council further finds that the proposed special use is so
designed, located and proposed to be operated that the public health,
safety and welfare will be protected in that the use of the property for
church purposes is compatible with surrounding uses and will not cause
substantial injury to the value of other property in the neighborhood
in which it is located.
Section 3. That a special use be and is hereby granted to the New
fir+ Covenant Fellowship, Inc. for the structural alteration, maintenance and
operation of the premises for use as a church.
Section 4. That this ordinance shall be in full force and effect from
and after its passage in the manner provided by law.
