AN ORDINANCE
GRANTING A SPECIAL USE FOR AN OPEN SALES LOT AT 236 DUNDEE AVENUE
WHEREAS, written application has been made for a special use to
permit the operation of a used car lot on the premises commonly known
as 236 Dundee Avenue, Elgin, Illinois; and
WHEREAS, the Land Use Committee conducted a public hearing on said
application after due notice as required by law; and
WHEREAS, the Land Use Committee recommended that the special use
requested be granted subject to certain conditions; and
WHEREAS, the City Council of the City of Elgin concurs in the
recommendation of the Land Use Committee.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That the City Council hereby finds that the proposed
special use is necessary for the public convenience at the location
proposed in providing a used car lot in the B-3, Service Business
District;
The City Council further finds the proposed use, if granted,
eft subject to the conditions recommended by the Land Use Committee, is
so designed, located and proposed to be operated that the public
health, safety and welfare will be protected in that the two approaches
nearest the intersection will be closed off and cars will be prohibited
from within eight feet of the Kimball Street and Dundee Avenue lot lines
and advertising signs will be limited;
The City Council further finds that the proposed special use will
not cause substantial injury to the value of other property in the
neighborhood in which it is located as the proposed use replaces the
use of the property as a service station.
Section 2. That a special use permit be and is hereby granted to
permit the use of the property commonly known as 236 Dundee Avenue and
legally described as follows:
That part of Sub Lot A and Sub Lot B of E. W. Vining's
Subdivision of Lots 13, 15, 16 and 17 of P. J. Kimball Jr's.
Second Addition to Elgin described as follows: Commencing
at a point on the Easterly line of said Sub Lot A, 5.0 feet
Southwesterly from the Northeast corner thereof thence South
25 degrees West along the Easterly lines of said Sub Lots A
and B (being also the Westerly line of Dundee Avenue) a
distance of 122.5 feet; thence Northwesterly 103.1 feet to a
point South 5 degrees West, 462 links (30.69 feet) from the
eft Southwest corner of premises described in the deed to John
Nagel dated June 1, 1871 and recorded November 23, 1871 in
Book 131 on page 574 thence North 5 degrees East, 462 links
(30.69 feet) to the Southwest corner of said tract of land;
thence South 75 degrees 15 minuts East along the South line
of said tract, 56.53 feet; thence Northeasterly on a line
forming an angle of 89 degrees 29 minutes from Northwest to
North and Northeast with the last described line a distance
of 21.45 feet; thence Northerly a distance of 36.75 feet to
a point on the North line of said Sub Lot A lying 87.2 feet
West from the Northeast corner thereof; thence East on said
North line of Sub Lot A (being the South line of Kimball
Street) 82.2 feet to a point 5.0 feet West from the Northeast
corner thereof; thence Southeasterly a distance of 5.3 feet to
a point on the Easterly line of said Sub Lot A, 5.0 feet
Southwesterly from the Northeast corner thereof and the
point of beginning, in the City of Elgin, Kane County,
Illinois.
as a used car lot subject to the following conditions:
1. That no new structure or additions to the existing
structure shall be erected.
2. That the two drive approaches nearest the intersec-
tion shall be closed off in a manner acceptable to
the engineering division.
3. That all signs for the lot shall conform to the
proposed sign ordinance of the City of Elgin on
file with the Department of Community Development.
4. That customer parking and display area shall be
maintained as shown on Exhibit A which is attached
hereto and made a part hereof by reference.
5. That no motor vehicles, nor any parts thereof, shall
be allowed within eight feet of the lot lines of the
subject property fronting on Kimball Street and
Dundee Avenue.
Section 3. That this ordinance shall be in full force and effect
from and after its passage in the manner provided by law.
