re. AN ORDINANCE
CREATING THE FOUNTAIN SQUARE PLAZA MALL COMMISSION
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS:
Section 1. That there is hereby added to the City Code of Elgin, 1955,
as amended, the following:
"Article XII. Fountain Square Plaza Mall Commission.
121211. Creation of Commission. There is hereby created
the Fountain Square Plaza Mall Commission for the purpose of
advising and recommending to the City Council of the City of
Elgin, Illinois, acting as the corporate authorities of Special
Service Area Number 1, concerning the operation and maintenance
of Fountain Square Plaza, and for the purpose of performing such
functions as prescribed by the ordinance.
12-1212. Duties of the Commission. The Fountain Square
Plaza Mall Commission shall have the following powers and
duties, in addition to any other which may be granted by the
City Council of the City of Elgin, Illinois:
(a) To develop and recommend to the City Council
policy guidelines including recommended fees for the
use of the Fountain Square Plaza.
(b) To review, coordinate and approve promotional
activities and other special events in Fountain Square
Plaza.
(c) To review and approve permit applications for
the use of public property in Fountain Square Plaza; said
permits shall be issued by the City Clerk.
(d) To annually make recommendations to the City Council
concerning maintenance schedules and other improvements or
operating requirements of Fountain Square Plaza.
(e) To recommend to the City Council an annual budget
for the operation, maintenance and improvment of Fountain
Square Plaza, which shall be submitted no later than
October 15 of each year, except for the first year when a
budget shall be submitted by May 1.
(f) To review, recommend and coordinate graphics, signage,
landscaping and architectural changes in the Fountain Square
Plaza areas so as to promote the theme of Fountain Square
Plaza and to improve the aesthetics of the Fountain Square
Plaza area.
°'' (g) To promote compliance with applicable ordinances of
the City of Elgin.
12-1213. Membership. The Commission shall consist of eleven
members to be appointed by the City Council. Two of the commissioners
shall be owners or representatives of owners of real property in
Special Service Area Number 1; two commissioners shall be businessmen
or merchants doing business in Special Service Area Number 1; one
member shall be a consumers representative chosen at large from the
City; one member shall be a representative of the Elgin Chamber of
Commerce; one member shall be a representative of the Downtowners,
Inc; and the following persons shall be ex-officio members of the
commission: a member of the City Council of the City of Elgin, City
Engineer, Director of Parks and Recreation, and the Executive Vice-
President of the Elgin Area Chamber of Commerce.
12-1214. Terms. Initial appointments shall expire as follows:
Four Members May 1, 1977
Three Members May 1, 1978
All succeeding terms shall be for a two-year period. If during the
term of a commissioner he is no longer eligible or able to act as a
commissioner, then the office shall become vacant and the City
Council shall appoint a successor for the unexpired term.
12-1215. Meetings. The Commission shall meet at least once each
quarter and shall make a written report to the City Council concerning
its activities each quarter."
Section 2. That this ordinance shall be in full force and effect from
and after its passage as provided by law.
