HomeMy WebLinkAboutG13-76 eft Ordinance No. G13-76 AN ORDINANCE GRANTING A SPECIAL USE FOR A DISCOUNT SERVICE STATION AT 881 VILLA STREET, ELGIN, ILLINOIS WHEREAS, written application has been made for a special use permit to operate and maintain a discount service station at the property commonly known as 881 Villa Street, Elgin, Illinois; and WHEREAS, the Plan Commission has considered said application and sub- mitted its recommendations to the Zoning Board of Appeals and the City Council; and WHEREAS, the Zoning Board of Appeals has held a public hearing after due notice as required by law and has recommended that said special use permit be granted; and WHEREAS, the. City Council has considered the recommendations of the Plan Commission and the Zoning Board of Appeals. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. The City Council hereby finds and determines that the proposed special use for a discount service station at 881 Villa Street, Elgin, Illinois, is deemed necessary for the public convenience; The City Council further finds that the proposed special use upon the conditions hereinafter set forth are so designed, located and proposed to be operated so that the public health, safety and welfare will be protected; The City Council further finds that the proposed use will not cause sub- stantial injury to the property or to the property in the neighborhood in which it is located in that the property has been used in a similar manner and that appropriate conditions will be placed upon the special use to protect surrounding properties. Section 2. That a special use is hereby granted to Bernard E. Cavitt to maintain a discount service station on the following described premises: Lots 35 and 36, Block 4, East Lawn Addition to Elgin, in the City of Elgin, Cook County, Illinois, subject to the following conditions: 1. That the signage conform with the proposed sign ordinance: a. One flush mounted building sign, not to exceed 120 square feet; fift b. One pole sign, not to exceed 80 square feet per side, and not to exceed 22 feet in height; c. That no company flags, banners, or pennants be allowed. 2. At the time improvements are made to Villa Street, the two interior approaches on Villa shall be removed and the two outside approaches will be widened to 35 feet each. Additionally, the northerly approach shall be removed on Lucille Street. 3. That in the event that the station becomes vacant for a period of 180 days or more, the City may cause a public hearing to be held to consider the revocation of the special use granted and the demolition of the existing building. Section 3. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. That this ordinance shall be in full force and effect from and after its passage in the manner provided by law and shall be published in pamphlet form by authority of the City Council. s/ Richard L.
