HomeMy WebLinkAboutT7-75 Ordinance No. T7-75 AN ORDINANCE ESTABLISHING FEES FOR THE CONNECTION AND USE OF CERTAIN WATER MAIN IMPROVEMENTS WHEREAS, the City of Elgin has caused certain water main improvements to be made and identified as the Elgin Midland Industrial Park Water Main Extension; and WHEREAS, the following improvement has been made: A twelve inch (12") cast iron water main, complete with gate valves, vaults, hydrants and all cast iron fittings constructed within the public streets, described as follows: A twelve inch (12") water main, from and connected with an existing twelve inch (12") water main, at a point approximately two hundred and twenty feet (220') west of the west abutment of the bridge on State Route 19 (East Chicago Street) crossing Poplar Creek. Thence in an Easterly direction for a distance of one thousand six hundred and sixteen feet (1,616') parallel with the center line of State Route 19 at a distance of thirty-eight feet (38') south of the center line of State Route 19 to the intersection of State Route 19 and Lovell Road. Thence southerly for a distance of two thousand three hundred and sixty-nine feet (2,369') parallel with the center line of Lovell Road at a distance of six feet (6') east of the easterly pavement edge to the intersection of Sheldon Drive. Thence easterly for a distance of five hundred thirty-two feet (532') parallel with Sheldon Drive at a distance of forty feet (40') north of the southerly right-of-way line. WHEREAS, the cost of said improvements amount to $36,481.15; and WHEREAS, said improvement extends across abutting property located within the City of Elgin for a distance of 4,517 lineal feet; and WHEREAS, property abutting and adjoining said improvement consists of approximately 295.5 acres; and WHEREAS, the City of Elgin is a home rule unit empowered to exercise any power or perform any function pertaining to its government and affairs; and WHEREAS, the installation and maintenance of water mains is a function pertaining to the government and affairs of the City of Elgin; and WHEREAS, Elgin Midland Corporation has made payment to the City of Elgin for the cost of an equivalent eight inch (8") water main as other- wise described above; and WHEREAS, it is reasonable to require owners of property abutting or adjoining the aforesaid improvement to bear a proportionate share of the cost of an equivalent eight inch (8") water main as otherwise described above in the event said owners desire to connect to and use said water mains. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That any owners of property adjoining the above described Elgin Midland Industrial Park Water Main Extension who desire: to connect to and use said facilities shall pay to the City Treasurer of the City of Elgin, Illinois, a fee in an amount determined according to the front footage and total acreage of property in relation to the total front footage and total acreage of adjoining property. Said fee shall be in addition to any and all fees established by the City of Elgin for water service. Section 2. That in accordance with the provisions of Section 1 of this ordinance the following amounts are established and required to be paid for connection to the Elgin Midland Industrial Park Water Main Extension by property adjoining said improvement. Parcel I -- FSLIC Amount - $11,460.56 That part of the East half of Section 19, Township 41 North, Range 9 East of the Third Principal Meridian and the West half of Section 20, Town- ship and Range aforesaid described as follows: Commencing at the intersection of the Southerly line of State Route 19, with the center line of Lovell Road; thence South 7 degrees 20 minutes West along said center line a distance of 1023.36 feet; thence North 82 degrees 40 minutes West a distance of 33 feet; thence South 7 degrees 20 minutes West along the Westerly line of Lovell Road, for a distance of 268.6 feet; thence South 4 degrees 0 minutes West, along said Westerly line, a distance of 229.5 feet for a place of beginning; thence continuing Southerly along said Westerly line of Lovell Road, a distance of 2583 feet, more or less, to the Northerly line of Federal Aid Route 6, U.S. Route 20; thence 118 degrees 30 minutes to the right of a prolongation of the last described course, a distance of 205.25 feet; thence 18 degrees 51 minutes to the right of a prolongation of the last described course a distance of 275.14 feet; thence 5 degrees 29 minutes to the left of a prolongation of the last described course, a distance of 518.89 feet; thence 19 degrees 56 minutes to the left of a prolongation of the last described course a distance of 182.72 feet; thence 2 degrees 13 minutes to the left of a prolongation of the last described course a distance of 385.88 feet; thence 16 degrees 39 minutes to the left of a prolongation of the last described course a distance of 251.62 feet; thence 16 degrees 29 minutes to the left of a prolongation of the last described course a distance of 524.74 feet; thence 8 degrees 47 minutes to the left of a prolongation of the last described course a distance of 280.42 feet; thence Westerly, along the Northerly line of Business U.S. Route 20 which is parallel to and 112 feet Northeasterly of the center line of said Route 20, a distance of 505.0 feet; thence continuing Westerly along said Northerly line a distance of 906.19 feet; thence North 9 degrees 15 minutes East a distance of 665 feet, more or less to the center line of Maroon Drive; thence Easterly, along said center line, a distance of 1940 feet, more or less, to a point 178.75 feet Westerly of the East line of said Section 19; thence North, along a line parallel to and 178.75 feet West of said East line, a distance of 1269.85 feet; thence North 63 degrees 45 minutes East a distance of 200 feet to the East line of Section 19; thence North along said East line a distance of 622.7 feet, more or less, to the Southerly line of State Route 19; thence Easterly along said Southerly line, a distance of 643.36 feet, more or less, to the Westerly property line of Biggers Planned Unit Development; thence South 7 degrees 13 minutes West for a distance of 1432.64 feet; thence South 86 degrees 33 minutes East for a distance of 969.2 feet, more or less, to the place of beginning. Being situated in Hanover Township, Cook County, Illinois and containing 135 acres, more or less. Parcel II -- Biggers P.U.D. Amount - $ 3,361.74 That part of the Northwest Quarter of Section 20, Township 41 North, Range 9 East of the Third Principal Meridian described as follows: Beginning at the intersection of the Southerly line of State Route 19, with the center line of Lovell Road; thence South 7 degrees 20 minutes West along said center line for a distance of 1023.36 feet; thence North 82 degrees 40 minutes West a distance of 33 feet for a place of beginning; thence South 7 degrees 20 minutes West, along the Westerly line of Lovell Road, for a distance of 268.6 feet; thence South 4 degrees 0 minutes West, along said Westerly line, a distance of 229.5 feet, more or less; thence North 86 degrees 33 minutes West a distance of 969.2 feet, more or less, to an iron pin; thence North 7 degrees 13 minutes East for a distance of 1432.64 feet to the Southerly line of State Route 19; thence Easterly along said South line a distance of 461.48 feet; thence Southerly 525 feet along a 2.003 foot radius curve to the right; thence Southeasterly and Easterly along a curve to the left having a radius of 348 feet, a distance of 509.4 feet to a point; thence South 82 degrees 40 minutes East along a line tangent to the last described point, a distance of 118.97 feet to the place of beginning. Being situated in Hanover Township, Cook County, Illinois and containing 22 acres, more or less. Parcel III -- Biggers Auto Dealership Amount - $ 3,867.00 That part at the Northwest Quarter of Section 20, Township 41 North, Range 9 East of the Third Principal Meridian described as follows: Beginning at the intersection of the Southerly line of State Route 19, with the Center Line of Lovell Road; thence South 7 degrees 20 minutes West along said Center Line a distance of 1023.36 feet; thence North 82 degrees 40 minutes West a distance of 33 feet, to the West right-of- way line of Lovell Road, for a place of beginning; thence continuing North 82 degrees 40 minutes West for a distance of 118.97 feet; thence Northwesterly and Northerly along a curve to the right, having a radius of 348 feet and being tangent to the last described course, for a distance of 509.4 feet; thence Northerly along a 2,003 foot radius curve to the left a distance of 525.00 feet to the South line of State Route 19; thence Northeasterly along said South line a distance of 512 feet, more or less, to the West line of Lovell Road thence South 7 degrees 20 minutes West along said West line a distance of 1016 feet, more or less, to the place of beginning. Being situated in Hanover Township, Cook County, Illinois and containing 11 acres, more or less. Parcel IV -- North Side Woods Amount - $ 6,136.13 That part of the Southwest Quarter of Section 17, Township 41 North, Range 9 East of the Third Principal Meridian and the Northwest Quarter of Section 20, Township and Range aforesaid described as follows: Commencing at the intersection of the West line of said Section 17 with the Southerly line of Park Avenue; thence Easterly, along said Southerly line, a distance of 763.94 feet for a place of beginning; thence South 1 degree 32 minutes East a distance of 851.2 feet; thence South 89 degrees West a distance of 181.2 feet; thence Southerly for a distance of 635.5 feet; thence South 63 degrees 02 minutes West a distance of 230.6 feet; thence South 3 degrees 09 minutes West a distance of 1072 feet, more or less, to the Northerly line of State Route 19; thence Easterly along said Northerly line, a distance of 132 feet to the South line of Section 17; thence Easterly along said South line a distance of 950 feet; thence North 7 degrees 37 minutes West for a distance of 895.64 feet; thence North 8 degrees 01 minutes West for a distance of 1760.5 feet; thence in a Northerly direction a distance of 44.3 • feet to a point in the Southerly line of Park Avenue being 410.62 feet East of the place of beginning; thence Westerly, along said Southerly line, a distance of 410.62 feet to the place of beginning. Parcel V -- Midland/Sheldon Manufacturing Company Amount - $ 983.17 That part of the Northwest Quarter of Section 20, Township 41 North, Range 9 East of the Third Principal Meridian described as follows: Commenc- ing at the intersection of the center line of Lovell Road with the South line of Sheldon Drive; thence Easterly along said South line a distance of 245.1 feet; thence North 4 degrees 19 minutes East a distance of 60.06 feet for a place of beginning; thence continuing North 4 degrees 19 minutes East a distance of 741.18 feet; thence South 82 degrees 33 minutes East a distance of 349 feet; thence South 70 degrees 17 minutes East a distance of 740 feet, to the Northerly line, of Sheldon Drive as dedicated; thence Westerly, along said Northerly line, a distance of 315 feet, more or less, to the place of beginning. Parcel VI -- Schroeder's Amount - $ 4,175.26 Part of Section 20 Township 41 North, Range 9 East of the Third Principal Meridian described as follows: Beginning at the intersection of the Westerly right-of-way line of the E.J. & E. Railroad with the center line of Old Illinois Route 5; thence Northeasterly along said Westerly right-of-way line, for a distance of 700 feet to a point 550 feet Northerly of land dedicated for highway purposes by Document #9171745 for a place of beginning; 494, thence Northwesterly 230.16 feet, parallel with the North line of lands dedicated by Document #9171745; thence Southerly parallel with the Westerly right-of-way line of the E.J. & E. Railroad, for a distance of 504.76 feet to a point in a line 45 feet Northerly of (measured at right angles thereto) and parallel with the North line of lands dedicated by Document #9171745; thence Northwesterly along said parallel line for a distance of 435.56 feet to an angle in said parallel line; thence Northwesterly, along said parallel line for a distance of 187.62 feet; thence Northerly, along a line that forms an angle of 76 degrees 24 minutes to the right with the prolongation of the last described course, a distance of 178.41 feet; thence Northwesterly, along a line that forms an angle of 84 degrees 58 minutes to the left with the prolongation of the last described course, a distance of 64.9 feet; thence Southerly, along a line that forms an angle of 89 degrees 48 minutes to the left with a prolongation of the last described course, for a distance of 73 feet, more or less, to the Northeast corner of land dedicated for highway purposes by Document #17993033; thence Northwesterly, along the North line of lands dedicated by Document #17993033, for a distance of 510 feet, more or less, to a point 41.55 feet East, measured along said North line, of the Easterly right-of-way line of the Public Service Company of Northern Illinois (Commonwealth Edison Company) as dedicated by Document #2542306; thence Northerly, along a line parallel to and 40.0 feet East of the Easterly right-of-way line of the lands conveyed to the Public Service Company of Northern Illinois (Commonwealth Edison Company) according to Document #9542306, a distance of 1726.83 feet; thence South 83 degrees 00 minutes East, along the Southerly right-of-way line of Sheldon Drive and the Southerly line of Midland Industrial Park, a distance of 1564.67 feet to the Westerly right-of-way line of the E.J. E E. Railroad; thence Southerly, along the Westerly right-of-way line of the E.J. $ E. Railroad, a distance of 1540 feet, more or less, to the place of beginning. All of the above described lands being situated in Hanover Township, Cook County, Illinois and containing 57 acres, more or less. Parcel VII -- Commonwealth Edison Amount - $ 6,497.29 That part of the Northwest Quarter of Section 20 Township 41 North Range 9 East of the Third Principal Meridian described as follows: Beginning at the intersection of the Southerly line of State Route 19 with the Easterly line of Lovell Road; thence Southerly, along said Easterly line of Lovell Road, for a distance of 2324 feet, more or less, to the Northerly line of Sheldon Drive; thence Easterly, along said Northerly line, for a distance of 217 feet, more or less, to the West line of Midland Industrial Park, thence North 4 degrees 19 minutes East, a distance of 2370 feet, more or less, to the Southerly line of State Route 19; thence Westerly along said Southerly line for a distance of 158.77 feet, more or less, to the place of beginning. Being situated in Hanover Township, Cook County, Illinois and containing 12 acres, more or less. Section 3. That the aforesaid amounts have been determined in accord- ance with Exhibit A which is attached hereto and made a part hereof. Section 4. That any property held in common ownership with other property subject to the provisions of this ordinance on the effective day of this ordinance shall be subject to payment based on the entire amount established for the entire parcel as provided in Section 2 of this ordinance. Section 5. That any person desiring to hook on to the aforesaid water main improvements may pay said amount in full without interest if payment is made prior to July 1, 1975, if said full payment is not made by July 1, 1975, then payment shall be made in full plus interest at the rate of 7% per annum accruing from and after July 1, 1975 to the date of payment. Section 6. That any amounts received by the City Treasurer for connec- tion and use of the above described water main for properties other than the parcel described as Parcel V shall be paid to Elgin Midland Corporation as reimbursement for monies advanced to the City of Elgin, Section 7. That a certified copy of this ordinance shall be recorded with the Recorder of Deeds of Cook County, Illinois. Section 8. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 9. That this ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law and shall be published in pamphlet form by authority of the City Council. s/ W.
