AN ORDINANCE
GRANTING A SPECIAL USE FOR A TELEVISION TRANSMISSION TOWER
AT 322 RENNER DRIVE
WHEREAS, written application has been made for a special use for a
television transmission tower at 322 Renner Drive, Elgin, Illinois; and
WHEREAS, the Plan Commission has forwarded its written report to
the Zoning Board of Appeals and the City Council; and
WHEREAS, a public hearing has been held by the Zoning Board of
Appeals after due notice; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and
recommended that the application be granted; and
WHEREAS, the City Council has reviewed the findings and recommendations
submitted to it.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That the City Council hereby finds that such establishment
and maintenance of a television transmission tower at the proposed location
k is necessary for the public convenience in providing required transmission
facilities for cable television offered to the public; that the public
health, safety and welfare will be protected by imposing the conditions
recommended by the Zoning Board of Appeals and the Plan Commission; and
that the proposed use will not cause substantial injury to other property
in the neighborhood in which it is located as the site is located in an
industrial park and the special use is compatible with other uses.
Section 2. That a special use be and is hereby granted to Consolidated
Cable Utilities, Inc. for the construction and oepration of a television
transmission tower on the premises legally described as follows:
The North 50 feet of Lot 21 and Lots 22, 23 and 24 in
Burnidge Industrial Park, Unit 4 in the City of Elgin, Kane
County, Illinois.
commonly known as 322 Renner Drive.
Section 3. That the special use herein granted be and is hereby made
subject to the following conditions:
1. That the tower shall be located as shown on the site
plan submitted as an attachment to the petition and attached
hereto as Exhibit "A" and incorporated herein by reference.
2. That the tower shall not exceed 100 feet in height.
3. That the tower shall be painted a color determined
by the Department of Community Development to be compatible
with the building.
4. That a landscaping plan screening the base of the
tower shall be submitted and approved by the Department of
Community Development prior to construction.
5. That the special use shall be void if construction
has not commenced within six months of the passage of this
ordinance.
6. That if the franchise for cable television trans-
mission to Consolidated Cable Utilities, Inc. issued by the
City of Elgin is terminated, the tower shall be removed within
180 days.
Section 4. That this ordinance shall be in full force and effect from
and after its passage in the manner provided by law and shall be published
in pamphlet form by authority of the City Council.
