HomeMy WebLinkAboutG61-75 Ordinance No. G61-75 AN ORDINANCE TO AMEND THE ELGIN ZONING ORDINANCE TO PROVIDE FOR DAY CARE SERVICE IN PRIVATE RESIDENCES AND INSTITUTIONAL SETTINGS WHEREAS, an amendment has been proposed to the Zoning Ordinance of the City of Elgin to allow day care service in private residences and institutional settings; and WHEREAS, the Plan Commission has reviewed said proposal and submitted its findings and recommendations to the City Council and Zoning Board of Appeals; and WHEREAS, the Zoning Board of Appeals conducted a public hearing after due notice as required by the statutes of the State of Illinois and the Zoning Ordinance of the City of Elgin; and WHEREAS, the Zoning Board of Appeals has recommended that said proposed amendment be made. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Section 21-103 of Chapter 21 of the Municipal Code of Elgin, be and is hereby amended to include the following: "Home Day Care Service--A residence which receives a license from the State of Illinois Department of Children and Family Services for not more than eight (8) children for care during the day. The maximum number of children under age 18 being cared for, including the family's natural or adopted children, shall not exceed eight (8)." Section 2. That Section 21-103 of Chapter 21 of the Municipal Code of Elgin, be and is hereby amended to include the following: "Institutional Day Care Service--A day care service to be licensed by the State of Illinois Department of Children and Family Services, operated in conjunction with or accessory to an institutional facility such as, but not limited to: a. Churches b. Schools, Public c. Schools, Private" Section 3. That Section 21-107B(1) of Chapter 21 of the Municipal Code of Elgin, be and is hereby amended by adding: "g. Home day care service" r Section 4. That Section 21-107B(2) of Chapter 21 of the Municipal Code of Elgin, be and is hereby amended by adding the following: "r. Institutional day care service" Section 5. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 6. That this ordinance shall be in full force and effect from and after its passage in the manner provided by law and shall be published in pamphlet form by authority of the City Council. s/ Richard L.
