AN ORDINANCE
RECLASSIFYING PROPERTY AT 36 NORTH McLEAN BOULEVARD FROM
R-4, GENERAL RESIDENCE DISTRICT, TO B-1, COMMUNITY BUSINESS DISTRICT
WHEREAS, written application has been made to reclassify certain
property located at 36 North McLean Boulevard, Elgin, Illinois, from the
R-4, General Residence District, to the B-1, Community Business District;
and
WHEREAS, the Plan Commission has reported its findings and recommenda-
tions to the Zoning Board of Appeals and the City Council; and
WHEREAS, the Zoning Board of Appeals has conducted a public hearing
as required by statutes of the State of Illinois and the zoning ordinance
of the City of Elgin; and
WHEREAS, the Zoning Board of Appeals has reported its recommendations
to the City Council.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That Sub-section B of Section 21-106 of Chapter 21 of the
zoning ordinance of the City of Elgin, Illinois, as amended, be and is
hereby further amended by adding the following paragraph:
"That the boundaries hereinbefore described and laid out
in the 'Zoning District Map' as amended, be further amended
by excluding from the R-4, General Residence District, and
including in the B-1, Community Business District, the following
described premises:
That part of the Northeast quarter of the Southwest quarter
of Section 15, Township 41 North, Range 8 East of the Third
Principal Meridian, described as follows: Commencing at the
point of intersection of the Northerly line of Larkin Avenue
with the East line of said Southwest quarter; thence North
along said East line 144.50 feet for the point of beginning;
thence West at right angles to said East line 140 feet; thence
North parallel with said East line 70 feet; thence East at
right angles to the last described course 140 feet to the East
line of said Southwest quarter; thence South along said East
line 70 feet to the point of beginning, in the City of Elgin,
Kane County, Illinois."

Section 2. That the premises herein described shall be used solely for
the purpose of operating and maintaining a real estate insurance sales office
subject to the following conditions:
A. Approval by the Department of Community Development
of any sign proposed to be used on the premises provided, however,
that said sign shall not be of the neon or flashing type or of
such nature as to disturb the surrounding neighborhood.
B. That no motor vehicle shall be parked between the street
and the front line of the building.
C. That in the event that the zoning ordinance of the City
of Elgin is amended to place the subject premises in a transition
zone authorizing the use of the premises for real estate insurance
sale office, the property shall commence such proceedings as may
be necessary to conform to the amendment, if any.
D. That the property owner shall submit a written restrictive
covenant running with the land in form suitable for recording and
approved by the Corporation Counsel within 30 days of passage of
this ordinance.
Section 3. That in the event that any condition of this ordinance is not
complied with subject property shall revert to the prior zoning classification
without further action of the City Council.
Section 4. That all ordinances or parts of ordinances in conflict with
the provisions of this ordinance are hereby repealed.
Section 5. That this ordinance shall be in full force and effect from
and after its passage in the manner provided by law.
