AN ORDINANCE
AMENDING CHAPTER 19 OF THE CITY CODE OF ELGIN BY ADOPTING BY
REFERENCE THE B.O.C.A. BASIC BUILDING CODE--1975
WHEREAS, the City of Elgin has adopted by reference the B.O.C.A. Basic
Building Code--1975 as the Building Code of the City of Elgin; and
WHEREAS, the 1975 Edition of said Basic Building Code has been
published; and
WHEREAS, the City of Elgin desires to amend the Building Code by adopting
by reference the 1975 Edition of the B.O.C.A. Basic Building Code; and
WHEREAS, three copies of said regulations have been placed on file with
the City Clerk prior to adoption of this ordinance as required by the statutes
of the State of Illinois.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That Section 19-102 of Article 1 of Chapter 19 of the City
Code of Elgin is hereby amended to read as follows:
"19.102. Adoption of the Basic Building Code.
The regulations of the 1975 Edition as recommended and published
by the Building Officials and Code Administrator International,
Incorporated, published in pamphlet form, are hereby adopted as
the regulations governing the construction of buildings and other
structures in the City of Elgin with such amendments as are herein-
after set forth in Section 19-103."
Section 2. That Section 19-103 of Article I of Chapter 19 of the City
Code of Elgin is hereby amended by adding the following:
"'k' Sections 1202.2, 1202.3, 1202.4, 1202.5, 1202.6, 1202.7,
1202.8, 1202.9, 1201.10, 1202.11 and 1202.13 of Article 12 are hereby
deleted in their entirety.
'1' Section 1202.1 of Article 12 is hereby amended to read
as follows:
'1202.1. Where required: Fire suppression systems shall be
installed and maintained in full operating condition, as specified
in this code, in the following locations except one- and two-family
dwellings.
a. An approved automatic sprinkler system shall be installed and
throughout every building more than four stories in height.
eft b. Especially Hazardous Properties.
Throughout every building, which by reason of its highly
combustible occupancy involves a severe life hazard to its
occupants or in the judgment of the Chief of the Fire Depart-
ment constitutes a fire menace to adjoining property.
c. Buildings for the Manufacture, Storage or Sale of Combustible
Goods or Merchandise.
Throughout every Class 1-A, 1-B building occupied in whole or
in part for the manufacture, storage, or sale of combustible
goods or merchandise, if over two stories in height and more
than seven thousand five hundred square feet in area.
Throughout every building of Type 2, 3 and 4 construction
occupied in whole or in part, for the manufacture, storage or
sale of combustible goods or merchandise, of more than seven
thousand five hundred square feet in area.
d. Garages.
Throughout all garages as follows: Type 1-A, 1-B buildings
over 10,000 square feet area.
Type 2, 3 and 4 buildings over 6,000 square feet in area.
e. Assembly Occupancies.
Throughout all buildings if such places of assembly are located
above or below the first or grade floor regardless of type of
construction.
Exception: Buildings used as schools, churches, colleges and
for similar religious or educational purposes shall meet the
requirements of f.
f. Assembly Occupancies.
Throughout all exitway stairways, shops, kitchens, storage
areas, janitor closets or other spaces where combustible
materials are stored or handled regardless of type of construc-
tion if such building is over 4,800 square feet in area.
g. Institutional Buildings.
Throughout all hospital and institutional buildings regardless
of type of construction.
Exception: Sprinklers may be omitted in security areas of
penal type institutions.
h. Residential - Hotels.
In the basements, cellars, store rooms, kitchens, work rooms,
hallways and stairways of all Use Group (L-1) occupancies of
type 1-A and 1-B construction more than three stories in
height and more than two stories in height if over 5,000 square
feet in area and throughout all such buildings of type 2, 3
and 4 construction.
i. Residential - Other than one- or two-family.
In the basements, cellars, store rooms, work rooms, hallways,
and stairways of all Use Group (L-2) occupancies of type 1-A
and 1-B construction more than three stories in height and more
than two stories in height if over 5,000 square feet in area.
In these areas of all buildings of type 2, 3 and 4 construction.
j . Bus garages. In all bus garages:
1. when used as passenger terminals for four (4) or more
buses; or
2. when used for storage or loading of four (4) or more
buses.
k. Unlimited area buildings. In "unlimited area buildings" as
required by Section 307.0.
1. Aircraft hangars. In aircraft hangars.
m. Storage and workshop areas.
In all portions of use groups A (assembly) , B (business) , I
(institutional) or R-1 and R-2 (residential, hotels and multi-
family) occupied for storage, workshop or similar purposes.
Exception: Individual storage or work-shop areas located
entirely within a dwelling unit.
n. Cellar or basement.
In every story, cellar or basement of all buildings where there
is not provided at least twenty (20) square feet of opening
entirely above the adjoining grade level in each fifty (50)
lineal feet of exterior wall in the story, cellar or basement,
on at least two (2) sides of the building. Openings shall have
a minimum dimension of not less than twenty-two (22) inches.
Such openings shall be unobstructed to allow fire-fighting and
rescue operations from the exterior.
Exception: If the area of a cellar exceeds two thousand, five
hundred (2,500) square feet, an automatic fire suppression
system is required.
For pusposes of this section, an opening in an exterior wall
qualifies as follows:
1. doors or access panels may be included in the determination
of openings;
2. windows may be included in the determination of openings if
they provide a breakable glazed area of not less than
twenty-two (22) inches in its least clear dimension.
o. Painting rooms.
In spray painting rooms or shops where painting, brushing,
dipping, or mixing is regularly conducted using flammable
materials.
p. Trash rooms and chutes.
In rooms or areas used for incineration, trash, laundry
collection, or similar uses. At alternate floor levels and
at the top of all chutes used in conjunction with these rooms
or areas.
q. Furnace rooms.
In furnace rooms, boiler rooms and rooms for similar uses.
Exception: Such room located entirely within and serving a
single dwelling unit.
r. Unenclosed vertical openings.
In unenclosed vertical openings between floors as required by
Sections 520.0 and 616.8.
s. Range hoods.
In range hoods, in accordance with the mechanical code listed
in Appendix B.
t. Alternate protection.
In special use areas of buildings or structures, an automatic
fire alarms system may be installed in lieu of a fire suppression
system when approved by the building official and fire department
and when such fire suppression system installation would be
detrimental or dangerous to the specific use or occupancy."
Section 3. That all ordinances or parts of ordinances in conflict with
the provisions of this ordinance are hereby repealed.
Section 4. That this ordinance shall be in full force and effect from
and after its passage as provided by law and shall be published in pamphlet
form by order of the City Council.
