AN ORDINANCE
RECLASSIFYING CERTAIN PROPERTY ON THE WEST SIDE OF STATE STREET
BETWEEN CHICAGO STREET AND HIGHLAND AVENUE AND THE
CHICAGO AND NORTH WESTERN RAILROAD FROM M-1 DISTRICT TO B-3 DISTRICT
WHEREAS, an amendment has been proposed to the zoning map of the City
of Elgin, Illinois, to reclassify certain property located on the west side
of State Street between Chicago Street and Highland Avenue and the Chicago
and North Western Railroad from M-1, Manufacturing, to B-3, Service Business
District; and
WHEREAS, the Plan Commission has reviewed said proposal and submitted
its findings and recommendations to the City Council and Zoning Board of
Appeals; and
WHEREAS, the Zoning Board of Appeals conducted a public hearing after
due notice as required by the statutes of the State of Illinois and the
Zoning Ordinance of the City of Elgin; and
WHEREAS, the Zoning Board of Appeals has recommended that said proposed
amendment be made.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That Section 21-106B of Chapter 21 of the Municipal Code
of the City of Elgin, Illinois, be and is hereby amended by deleting the
following legally described property from M-1, Manufacturing, and including
said property in the B-3, Service Business District:
That part of the Southeast Quarter of Section 14, Township
41 North, Range 8 East of the Third Principal Meridian described
as follows: All of Block 29 of William C. Kimball's Plat of the
West Side of the City of Elgin except the following: Beginning
at the Northwest corner of said Block 29; thence in a southeasterly
direction along the westerly line of said block for a distance of
264 feet to the Southwest corner of said block; thence in a north-
easterly direction along the southerly line of said block, for a
distance of 66 feet; thence northwesterly, along a line parallel
with the westerly line of said block, for a distance of 83.04 feet;
thence southwesterly along a line parallel with the southerly line
of said block, for a distance of 12 feet; thence in a northwesterly
direction, along a line parallel to and 54 feet east of the westerly
line of said block, for a distance of 81.46 feet; thence in a
northwesterly direction, along a line forming an angle to the left
of a prlongation of the last described course, to a point on the
south line of Lot 8, being 44.68,feet east of the west line of said
Block 29; thence in a westerly direction to a point being one foot
west of the easterly line and 2.25 feet north of the southerly line
of Lot 1 of said block; thence in a northwesterly direction, along
a line parallel and 40 feet east of the west line of said block, for
a distance of 63.75 feet to the northerly line of said block; thence
southwesterly along said north line for a distance of 40 feet to the
place of beginning. All of the above described property being
located in the City of Elgin, Kane County, Illinois. (Said
properties being located west of North State Street and East
of the Chicago and North Western right-of-way between Chicago
Street and West Highland Avenue) .
Section 2. That all ordinances or parts of ordinances in conflict with
the provisions of this ordinance are hereby repealed.
Section 3. That this ordinance shall be in full force and effect from
and after its passage in the manner provided by law and shall be published
in pamphlet form by authority of the City Council.
