HomeMy WebLinkAboutG29-75 Ordinance No. G29-75 AN ORDINANCE RECLASSIFYING PROPERTY AT 925 SOUTH McLEAN BOULEVARD FROM R-2 DISTRICT TO R-4 DISTRICT AND GRANTING A SPECIAL USE FOR INSTITUTIONAL HEADQUARTERS FOR A FRATERNAL ORGANIZATION WHEREAS, written application has been made to reclassify certain property located at 925 South McLean Boulevard, Elgin, Kane County, Illinois, from the R-2, Single Family Residence District, to the R-4, General Residence District, and for a special use for an institutional headquarters for a fraternal organization; and WHEREAS, the Plan Commission has prepared and forwarded its written report to the Zoning Board of Appeals and the City Council; and WHEREAS, a public hearing has been held by the Zoning Board of Appeals after due notice by publication as provided by state statute and the Elgin Zoning Ordinance; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the City Council. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: eik Section 1. That Subsection B of Section 21-106 of Chapter 21 of the Zoning Ordinance of the City of Elgin, Illinois, as amended, be and is hereby further amended by adding the following paragraph: "That the boundaries hereinbefore described in the 'Zoning District Map' as amended, be further amended excluding from the R-2, Single Family Residence, and including in the R-4, General Residence District, the following described property: That part of the North half of Section 27, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing on the West line of the Northeast quarter of said Section 27, 6.50 chains South of the Northwest corner of said Northeast quarter, thence East 5.20 chains, thence South 13.50 chains, thence West 17.73 chains to the center of the high- way, thence North along the center of the highway to a point 6.50 chains due South of the North line of said Section 27, thence East 11.24 chains to the place of beginning, (excepting therefrom the North 10 acres thereof and also that part dedicated to the People of the State of Illinois by instrument dated May 27, 1932 and recorded November 9, 1932 as Document 360847 in Book 923, Page 593) in the City of Elgin, Kane County, Illinois." commonly known as 925 South McLean Boulevard, Kane County, Illinois. r Section 2. That a special use be and is hereby granted to the Loyal Order of Moose, Elgin Lodge 799, for the construction, maintenance and All operation of an institutional headquarters building subject to the follow- ing conditions: 1. that an additional dedication of land along McLean Boulevard be made to the City of Elgin so as to provide a 50 foot right of way from the center line of McLean Boulevard. 2. that a site plan be submitted and approved prior to the application for any building permit. 3. that no building permit shall begranted until an adequate municipal water supply is available and adequate provisions for sanitary sewer service assured. 4. that construction of the proposed institutional headquarters shall be commenced within three years of the effective date of this ordinance. 5. that no liquor license shall be issued until the subject premises comply with the provisions of the Illinois Revised Statutes limiting the location of licensed premises in the vicinity of schools and churches. Section 3. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4.
