HomeMy WebLinkAboutG10-75 r Ordinance No. G10-75 AN ORDINANCE AMENDING CHAPTER 12 OF THE CITY CODE ENTITLED "DEPARTMENT OF CEMETERIES" BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That there is hereby added to Chapter 12 of the City Code of Elgin, Illinois the following: "Section 12-llb. Installment Sales. Any purchase of a lot or grave space and perpetual care of such lot or grave space may be made in installments as follows: $200 Or less - 1 year with 10% down payment $201 to $400 - 18 months with $20 minimum down payment $401 to $800 - 24 months with 5% minimum down payment $801 to $1,200 - 30 months with 5% minimum down payment over $1,200 - 36 months with 5% minimum down payment Interest shall be added at the rate of 12% per annum on the unpaid balance at the conclusion of the contract expiration date. All monies received under a contract delinquent for more than one year shall be transferred to the Cemetery Improvement Account for investment of income for general maintenance of the cemetery." eft Section 2. That there shall hereby be added to Chapter 12 of the City Code of Elgin the following: "Section 12-l1c. Reconveyance of Unused Space. Any lot or grave space from which perpetual care has been provided may be reconveyed to the City of Elgin by execution of a quitclaim deed. A credit of $40 for each usuable and unencumbered space reconveyed to the City shall be given to the grantor to provide perpetual care on any lot owned by the grantor." Section 3. That there shall hereby be added to Chapter 12 of the City Code of Elgin the following: "Section 12-ild. Usuable and Unencumbered Grave Space. A usuable and unencumbered grave space without perpetual care may be quitclaimed to the City of Elgin. A credit of $40 will be allowed towards perpetual care on the same lot as the graves quit- claimed to the City of Elgin." Section 4. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 5. That this ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law and shall be published in pamphlet form by authority of the City Council. s/ W.
