HomeMy WebLinkAboutG46-74 Ordinance No. G46-74 AN ORDINANCE REGULATING THE USE OF BICYCLES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Sections 29-201 through 29-206 of Article II of Chapter 29 of the Elgin City Code, be and is hereby repealed. Section 2. That Article XV entitled Bicycles, be and is hereby added to Chapter 17 of the Elgin City Code, as amended, to read as follows: ARTICLE XV. BICYCLES 17-1501. Definition. A bicycle, as herein mentioned, is a device having two tandem wheels of a diameter not less than ten (10) inches and propelled by human power. 17-1502. Effect of Regulations. (a) It is an offense for any person to do any act forbidden by this article or fail to perform any act required by this article. (b) The parent of any minor and the guardian of any ward shall not authorize or knowingly permit any such minor or ward to violate any of the provisions of this ordinance. (c) These regulations applic- able to bicycles shall apply whenever a bicycle is operated upon any street, roadway, or public place upon any path set aside for the exclusive use of bicycles subject to those exceptions stated herein. 17-1503. Traffic laws apply to persons riding bicycles. Every person riding a bicycle upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a motor vehicle by the laws of this state declaring rules of the road applicable to motor vehicles or by the traffic ordinances of this city applicable to the driver of a motor vehicle, except as to special regula- tions in this article and except as to those provisions of laws and ordinances which by their nature can have no applica- tion. 17-1504. Obedience to traffic-control devices. (a) Any person operating a bicycle shall obey the instructions of official traffic-control signals, signs, and other control devices applicable to vehicles, unless otherwise directed by a police officer. (b) Whenever authorized signs are erected indicating that no right or left or U turn is permitted, no person operat- ing a bicycle shall disobey the direction of any such sign, except where such person dismounts from the bicycle to make any such turn, in which event such person shall then obey the regulations applicable to pedestrians. '' 17-1505. Riding on bicycles. (a) A person propelling a bicycle , shall not ride other than astride a permanent and regular seat attached thereto. (b) No bicycle shall be used to carry more than one person at one time than the number of which it is designed and equipped. 17-1506. Riding on roadways and bicycle paths. (a) Every person operating a bicycle upon a roadway shall ride as near to the right side of the roadway as practicable, exercis- ing due care when passing a standing vehicle or one proceeding in the same direction. (b) Persons riding bicycles upon a roadway shall not ride more than two abreast except on parts of roadways set aside for the exclusive use of bicycles. (c) Wherever a usable path for bicycles has been provided, adjacent to a roadway, bicycle riders shall use such path and shall not use the roadway. 17-1507. Speed. No person shall operate a bicycle at a speed greater than is reasonable and prudent under the condi- tions then existing. 17-1508. Emerging from alley or driveway. The operator of a bicycle emerging from an alley, driveway or building shall upon approaching a sidewalk or the sidewalk area extending across any alleyway, yield the right of way to all pedestrians approach- ing on said sidewalk or sidewalk area and, upon entering the roadway, shall yield the right of way to all vehicles approach- ing on said roadway. 17-1509. Carrying articles. No person operating a bicycle shall carry any package, bundle or article which prevents the rider from keeping at least one hand upon the handle bars. 17-1510. Parking. No person shall park a bicycle upon a street other than upon the roadway and against the curb or upon the sidewalk in a rack to support the bicycle or against a building or at the curb, in such a manner as to afford the least obstruc- tion to pedestrian traffic. 17-1511. Riding on sidewalks. (a) No person shall ride a bicycle upon a sidewalk within a business district. (b) No person 15 or more years of age shall ride a bicycle upon any sidewalk in any district. (c) Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right of way to any pedestrian and shall give an audible signal before overtaking and passing such pedestrian. 17-1512. Lamps and other equipment on bicycles. (a) Every bicycle when in use at night time shall be equipped with a lamp on the front which shall emit'a white light visible from a distance of at least 500 feet to the front and with a red reflector on the rear of a type which shall be visible from all distances from 100 feet to 300 feet to the rear when directly in front of lawful lower beams of headlamps on a motor vehicle. A lamp emitting a red light visible from a distance of 300 feet to the rear may be used in lieu of a red reflector. (b) No person shall operate a bicycle unless it is equipped with a bell or other device capable of giving a signal audible for a distance of at least 100 feet, except that a bicycle shall not be equipped with nor shall any person use upon a bicycle any siren or whistle. (c) Every bicycle shall be equipped '" with a brake which will enable the operator to make the braked wheel skid on dry, level, clean pavement. e 17-1513. Registration. No person who resides within the munici- pality shall ride or operate a bicycle upon any roadway or public p place within the City of Elgin unless said bicycle has been properly registered and tagged in accordance with the following regulations. 1. Every owner of any bicycle who resides within the City of Elgin shall make application for the registration of said bicycle with the Chief of Police on a form provided for that purpose. 2. Registration of bicycles shall be serial numbered and kept on file by the Chief of Police in his office as a public record. 3. The Chief of Police, upon receiving proper registration of a bicycle, shall affix or cause to be affixed, to the rear fender or frame of the bicycle an identification tag or plate, serially numbered to correspond to the bicycle's registration, in such position to be plainly visible. A registration card shall be issued to the owner of each properly registered bicycle. 4. A charge of twenty-five (25) cents per registration shall be made for the registration and tag of any bicycle. 5. The Chief of Police shall keep a record of: a. The number of each registration. b. Date issued. c. Name and address of person to whom issued. d. The make and number of each bicycle frame. 6. Bicycles registered under the provisions hereof shall be registered biennially. The Chief of Police shall affix a registra- tion tag or plate to each bicycle at the time of registration or re-registration. 7. The Chief of Police shall affix or cause to be affixed on any bicycle not having a serial number on it's frame, a serial number placed on the underside of said bicycles sprocket and shall maintain a public record of such serial number and the bicycle so stamped. 8. It shall be unlawful for any person wilfully or maliciously to remove, destroy, mutilate or alter the identification tag or plate, frame number of the bicycle or the registration card issued to the owner thereof. 17-1514. Inspection. The Chief of Police shall inspect or cause to be inspected each bicycle presented for registration and shall refuse to register any bicycle found to be in an unsafe condition mechanically or lacking the equipment required under the terms of this article. 17-1515. Report of Sales. Every person engaged in the business of buying or selling new or second hand bicycles shall make a report within five (5) days to the Chief of Police of every bicycle purchased or sold by such dealer, giving: • - a. The name and address of the person from whom purchased or to whom sold. b. A description of such bicycle by name or make. c. The frame number thereof. d. The number of the identification plate, if any, found thereon. 17-1516. Rental Agencies. A rental agency shall not rent or offer any bicycle for rent unless the bicycle is properly registered and tagged and unless such bicycle is provided with the equipment required under the terms of this article. 17-1517. Impoundment. Any bicycle found upon any street, public way or other public property without current registration or lacking a serial number may be impounded by a police officer of the City of Elgin until ownership is established and registration made as provided in this article. Any bicycle not redeemed within 30 days after impound- ment may be disposed of in the same manner as other unclaimed property held by the Police Department. 17-1518. Penalties. (a) Every person convicted of a violation of sections 1501 through 1518 of this article shall be punished by a fine of not more than $25.00. (b) Every person convicted of a violation of section 1513 of this article shall be punished by a fine of not more than $10.00 for each offense. s/ W. E. Rauschenberger W. E. AN ORDINANCE ESTABLISHING LIMITED PARKING AREAS ON THE WEST SIDE OF CRYSTAL AVENUE FROM LAWRENCE AVENUE TO MILL STREET BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Section 17-1004 of Article X of Chapter 17 of the Elgin City Code, as amended, is hereby amended by adding to the designated places hwere parking is prohibited under Subsection 17-1003-3(c)13 the following: Crystal Avenue, west side, from Lawrence Avenue to Mill Street from 9:00 p.m. to 2:00 a.m. Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. That this ordinance shall be in full force and effect from and after its passage in the manner provided by law and shall be published in pamphlet form by authority of the City Council. s/ W. E.
