AN ORDINANCE
AUTHORIZING THE SALE OF CONFECTIONS FROM VEHICLES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS:
Section 1. That the following section is hereby added to Article VI
of the City Code of Elgin, Illinois:
"27.606. Confection Sales. Notwithstanding the provisions
of Section 27-605, it shall be lawful to sell or offer for sale
confections in the nature of popcorn, peanuts and candy from a
vehicle parked in a lawful parking place when authorized by per-
mit granted by the City Council of the City of Elgin, Illinois.
Such sales shall be restricted to the central business district
as defined in the Zoning Ordinance. Application for such permit
shall be made to the City Council in writing identifying the
applicant, describing the vehicle to be used, the activities
to be conducted, the hours of operation and such other informa-
tion as may be required by the City Council. Any such activities
for which a permit is issued shall not be conducted unless an
attendant is present at all times during which the vehicle used
is located on public property. No such activities shall be com-
menced until such time as a certificate of insurance naming the
City of Elgin, Illinois as an additional insured issued by an
insurance company authorized to do business in the State of
Illinois with limits of $100,000 for property damage and $500,000
for injury to persons is filed with the City Clerk. Any such
activity authorized shall comply with all other applicable ordi-
nances."
Section 2. That this ordinance shall be in full force and effect from
and after its passage in the manner provided by law.
