HomeMy WebLinkAboutG37-74 Ordinance No. G37-74 AN ORDINANCE elk AT A SPECIAL USE FORAM AMUSEMENT ESTABLISHMENT AT 419 DUNDEE AVENUE, ELGIN, ILLINOIS WHEREAS, a written petition has been filed for a special use to permit the use of the premises at 419 Dundee Avenue, Elgin, Illinois as an amusement establishment; and WHEREAS, the Plan Commission has submitted its report to the Zoning Board of Appeals and the City Council; and WHEREAS, the Zoning Board of Appeals after due notice conducted a public hearing and submitted its findings and recommended approval. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1, The City Council hereby finds that the location of an amuse- ment establishment at 419 Dundee Avenue, Elgin, Illinois, is deemed necessary for the public convenience as said location will provide an off-street site for the recreation of young persons who may otherwise tend to congregate in public areas surrounding the premises. The City Council further finds that the proposed amusement establishment is so designed, located and proposed to be operated that the public health, safety and welfare will be protected in that adequate supervision will be pro- vided and activities will be conducted in a commercial building. The City Council further finds that substantial injury to other property in the neighborhood will not result as the proposed use will be located in an existing commercial area with many retail outlets. Section 2. That a special use for an amusement establishment be and is hereby granted for the premises located at 419 Dundee Avenue, Elgin, Illinois, legally described as follows: The South 3 feet of Lot 9 and all of Lot 10 of Joseph Pabst Subdivision of Blocks 14 and 15 of Phinias Kimball Sr's. Addition in the City of Elgin, Kane County, Illinois. Section 3. That the special use herein granted shall terminate at such time as the amusement establishment authorized by said special use is no longer operated by William W. Spates. Section 4. That this ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law. s/ W. E. Rauschenberger W. E.
