HomeMy WebLinkAboutG36-74 Ordinance No. G36-74 AN ORDINANCE ZONING CERTAIN TERRITORIES ANNEXED TO THE CITY OF ELGIN WHEREAS, certain territories have been annexed to the City of Elgin, Illinois in accordance with a pre-annexation agreement; and WHEREAS, a written petition to classify said territory in the R-4, General Residence and B-3, Service Business Districts; and WHEREAS, the Plan Commission has reviewed said petition and made its recommendation to the Zoning Board of Appeals and the City Council; and WHEREAS, the Zoning Board of Appeals conducted a public hearing after due notice and has recommended that the classification requested be granted for the subject territory. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the following described territory be and is hereby included with B-3, Service Business District, as set forth in the Elgin Zoning Ordinance, as amended: That part of the Southwest Quarter of Section 16 and the Northwest Quarter of Section 21, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the intersection of the West line of Edgewood Street, being the West line of Walter G. McIntosh and Company's Fox River Acres, with the North line of South Street as established by deed recorded February 18, 1965, as Document No. 1040511; thence Westerly along the North line of South Street, a distance of 592.0 feet for the place of beginning; thence continuing Westerly along the North line of South Street, a distance of 354.05 feet to the Easterly line of Randall Road; thence Northeasterly along said Easterly line which forms an angle of 98 degrees 47 minutes 15 seconds to the right with the prolongation of the last described course, a distance of 1732.80 feet to the Southerly right of way line of the U.S. Route 20 Bypass (Federal Aid Route 6) as established by proceedings in the Circuit Court of Kane County, Illinois as Case No. 460-1166; thence Easterly along said Southerly line which forms an angle of 79 degrees 57 minutes to the right with the prolongation of the last described course, a distance of 143.45 feet to an angle in said Southerly line; thence Northeasterly along said Southerly line which forms an angle of 29 degrees 32 minutes to the left with the prolongation of the last described course, a distance of 225.0 feet; thence Southeasterly at right angles to the last described course, a distance of 80.0 feet; thence Southerly along a line that forms an angle of 32 degrees 30 minutes to the right with the prolongation of the last described course, a distance of 900.0 feet; thence Southwesterly along a line that forms an angle of 25 degrees 30 minutes to the right with the prolongation of the last described course, a distance of 553.0 feet; thence Southerly, fik a distance of 376 feet more or less to the place of beginning. Being situated in Elgin Township, Kane County, Illinois and containing 16 Acres more or less. • Section 2. That the following described territory be and is hereby included with R-4, General Residence District, as set forth in the Elgin Zoning Ordinance, as amended: Of that part of the Southwest Quarter of Section 16 and the Northwest Quarter of Section 21, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Beginning at the intersection of the West line of Edgewood Street, being the West line of Walter G. McIntosh and Company's Fox River Acres, with the North line of South Street, as established by deed recorded February 18, 1965, as Document No. 1040511; thence Westerly along the North line of South Street; a distance of 946.05 feet to the Easterly line of Randall Road; thence Northeasterly along said Easterly line which forms an angle of 98 degrees 47 minutes 15 seconds to the right with the pro- longation of the last described course, a distance of 1732.80 feet to the Southerly right of way line of the U.S. Route 20 Bypass (Federal Aid Route 6) as established by proceedings in the Circuit Court of Kane County, Illinois as Case No. 60-1166; thence Easterly along said Southerly line which forms an angle of 79 degrees 57 minutes to the right with the prolongation of the last described course, a distance of 143.45 feet to an angle in said Southerly line; thence Northeasterly along said Southerly line which forms an angle of 29 degrees 32 minutes to the left with the prolongation of the last described course, a distance of 332.73 feet to an angle in said Southerly line; thence Northeasterly along said Southerly line which forms an angle of 13 degrees 42 minutes 15 seconds to the right with the prolongation of the last described course, a distance of 166.1 feet to an angle in said Southerly line; thence Southeasterly along said Southerly line which forms an angle of 25 degrees 39 minutes 45 seconds to the right with the prolongation of the last described course, a distance of 151.76 feet to the West line of Edgewood Street; thence Southerly along said West line, a distance of 1913.20 feet to the place of beginning. EXCEPTING THEREFROM that part described as follows: Commencing at the intersection of the West line of Edgewood Street, being the West line of Walter G. Being situated in Elgin Township, Kane County, Illinois and containing 19 Acres more or less. Section 3. That Subsection b of Section 21-106 of Chapter 21 of the Zoning Ordinance of the City of Elgin, Illinois, as amended, be and hereby is further amended in accordance with Sections 1 and 2 of this ordinance. Section 4. That said territories shall be subject to the provisions of an annexation agreement entered into by the City of Elgin and Helen Busse and Dorothy Hesse on June 13, 1974. Section 5.
