HomeMy WebLinkAboutG-1647 Ordinance No. G-1647 AN ORDINANCE REZONING CERTAIN PROPERTY LOCATED SOUTH OF THE WEST END OF DANIELS AVENUE, ELGIN, ILLINOIS, AND GRANTING A SPECIAL USE FOR BUILDING MATERIAL SALES AND STORAGE. WHEREAS, written application has been made to reclassify certain property located south of the west end of Daniels Avenue from B-4, General Service District and R-4, General Residence District, to B-4, General Service District with a special use for building material sales and storage; and WHEREAS, the Plan Commission has reviewed said application and forwarded its report to the Zoning Board of Appeals and the City Council; and WHEREAS, a public hearing has been held by the Zoning Board of Appeals after due notice as required by the statutes of the State of Illinois and the Elgin Zoning Ordinance and the Zoning Board of Appeals has reported its find- ings and recommended that the application be granted upon certain conditions. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City of Elgin hereby finds that the use of the subject property for building material sales and storage is necessary for the public convenience. The City Council further finds that the proposed special use upon the conditions hereinafter set forth are so designed, located and proposed to be operated so that the public health, safety and welfare will be protected. That the City Council further finds that the proposed use will not cause substantial injury to the property or to the property in the neighbor- hood and which is limited in that the property has been used in a similar manner in that appropriate conditions will be placed upon the special use to protect surrounding properties. Section 2. That a special use is hereby granted to Harold T. Seigle to maintain a building material sales and storage lot on the following described premises: Lot 4 and that part of Lots 5 and 6 in Block 42 of A. J. Waldron's Subdivision of Out Lot 1, P. J. Kimball Jrs. Third Addition to Elgin described as follows: Beginning on the south line of Daniels Avenue 332 feet West of the West line of Grove Avenue; thence South parallel with said West line of Grove Avenue 119.07 feet to the South line of Lot 5; thence West along said South line 50.8 feet to the West line of Lot 5; thence North- westerly along the West line of said Lots 5 and 6 to the South line of Daniels Avenue; thence East along said South line 97.07 feet to the point of beginning, in the City of Elgin, Kane County, Illinois. (Located South of the West end of Daniels r� Avenue.) 7 subject to the following conditions: 1) The applicant submit a site plan showing proposed modifications to Daniels Avenue including new curbing, drainage provisions, screening fence with emergency access gate and landscaping acceptable to the City of Elgin. 2) That those portions of Lots 5 and 6 of Block 42 of A. J. Waldron's Subdivision of Out Lot 1, P. J. Kimball Jrs. Third Addition to Elgin, shall be used only for access to the adjacent storage area and employees parking. If said area is used for employees parking improvements it shall comply with all ordinances and regulations of the City of Elgin. 3) That the City shall cause the vacation of Daniels Avenue adjacent to that part of Lots 5 and 6 in Block 42 of A. J. Waldron's Subdivision of Out Lot 1, P. J. Kimball Jrs. Third Addition to Elgin excepting that portion of Daniels Avenue needed to construct the required street improvements. The terms for such vacation shall be established by the City of Elgin and included in a vacation ordinance. Section 3. That Subsection B of Section 21-106 of the City Code of Elgin, Illinois, as amended, be and the same is hereby further amended by adding thereto the following paragraph: That the boundaries hereinbefore laid out in the Zoning District Map be and are hereby altered by excluding from R-4, General Residence District and including in B-4, General Service District, the following described premises: Lot 4 and that part of Lots 5 and 6 in Block 42 of A. J. Waldron's Subdivision of Out Lot 1, P. J. Kimball Jrs. Third Addition to Elgin described as follows: Beginning on the south line of Daniels Avenue 332 feet West of the West line of Grove Avenue; thence South parallel with said West line of Grove Avenue 119.07 feet to the South line of Lot 5; thence West along said South line 50.8 feet to the West line of Lot 5; thence North- westerly along the West line of said Lots 5 and 6 to the South line of Daniels Avenue; thence East along said South line 97.07 feet to the point of beginning, in the City of Elgin, Kane County, Illinois. (Located South of the West end of Daniels Avenue.) Section 4. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 5.
