AN ORDINANCE
PROHIBITING THE PRESENCE OF MINORS IN CERTAIN ALCOHOLIC LIQUOR
ESTABLISHMENTS.
WHEREAS the City of Elgin is a home rule unit and by the terms of the -
Constitution of the State of Illinois, 1970, is empowered toexercise any
power pertaining to its government and affairs including, but not limited
to, the power to regulate for the protection of the public health, safety,
morals and welfare and to license; and
WHEREAS the City of Elgin in the exercise of said powers licenses
retail alcoholic liquor dealers; and

.IVHEREAS Section 110 of Chapter 43 of the Illinois Revised Statutes,
1971, empowers the City Council to prohibit any minor from at any time
attending any bar and to establish further regulations and restrictions
upon operation under local licenses not inconsistent with the law as the
public good and convenience may require; and
'WHEREAS---the City Council of the City of Elgin finds that the public
good and convenience will be promoted by prohibiting the presence of
• minors in-such retail alcoholic liquor establishments as are principally
devoted only to the sale of alcoholic liquor.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That Section 24-6 of Chapter 24 of the Municipal Code of
Elgin, Illinois, as amended, is hereby amended by adding Subsection (15)
to read as follows:
"(15) Permit any person, who. is not of lawful age to
purchase, possess or receive any alcoholic liquor, to remain
. - on the premises of a Class A licensee unless said person is
accompanied by his or her parent or legal guardian. This
subsection shall not apply to hotels, motels or bowling alleys
except areas segregated and designated principally for the sale
or consumption of alcoholic liquor."
Section 2. That Section 24-7 of Chapter 24 of the Municipal Code of
Elgin, Illinois, as amended, is hereby amended by adding Subsection (7) to
. -" read as follows:
"(7) It shall be unlawful for any person who is not of
lawful age to purchase, possess or receive alcoholic liquor,
to remain on any premises licensed as a Class A Alcoholic
Liquor Dealer unless said person is accompanied by his or her
parent or legal guardian. This subsection shall not apply to
hotels, motels -or bowling alleys except areas segregated and
designated principally for the sale or consumption of alcoholic
liquor."

Section 3. That all ordinances or parts of ordinances in conflict
with the provisions of this ordinance are hereby repealed.
Section 4. That this ordinance shall be in full force and effect
from and after its passage in the manner provided by law and shall be
published in pamphlet form by order of the City Council.
