AN ORDINANCE
GRANTING A SPECIAL USE FOR OFF-STREET PARKING AND A FRONT YARD SETBACK
VARIATION.
WHEREAS a written application has been made for a special use for
an off-street parking lot at 304 North Street, Elgin, Illinois and for
a variation from the front yard setback requirements of the Elgin Zoning
Ordinance; and
WHEREAS in accordance with the Zoning Ordinance of the City of Elgin,
the Plan Commission has prepared and forwarded a written report to the
Zoning Board of Appeals; and
WHEREAS a public hearing has been held by the Zoning Board of Appeals
after due notice in accordance with the statutes of the State of Illinois
and the applicable provisions of the Zoning Ordinance of the City of Elgin;
and
WHEREAS the Zoning Board of Appeals has reported its findings and
recommendations to the City Council; and
WHEREAS the City Council finds that an off-street parking lot on the
subject property is deemed necessary for the public convenience at that
location in relieving overburdened on-street parking in the immediate
area; and
WHEREAS the City Council further finds that by landscaping of the
subject property and the installation of screening of adjacent residential
property the public health, safety and welfare will be protected; and
WHEREAS the City Council further finds that the proposed special use
will not cause substantial injury to the value of other property which is
presently vacated will be substantially improved in appearance.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That special use for an off-street parking lot be and
is hereby granted on the property legally described as follows:
"That part of Lots 2 and 3 in B. W. Raymond's Addition to
Elgin, described as follows: Beginning at a point in the North
line of North Street, 5 feet West of the East line of said
Lot 2 aforesaid; thence North parallel with the East line of
said Lot, 75 feet; thence East parallel with the North line of
North Street 53 feet; thence South parallel with the East line of
Lot 2 aforesaid, 75 feet to the North line of North Street; thence
West along the North line of said street 53 feet to the point of
beginning, in the City of Elgin, Kane County, Illinois. (Commonly
known as 304 North Street.)"
subject to the following conditions:
(a) An eight-foot planting strip be provided along
North Street; 9 (01)
(b) That a screening fence or hedge be provided along
North Street and additional screening be provided along the
east and north boundaries of the subject property to screen
adjacent residential property;
(c) That the parking lot be surfaced and striped in
accordance with the applicable standards of the City of
Elgin.
Section 2. That all ordinances or parts of ordinances in conflict with
the provisions of this ordinance are hereby repealed.
Section 3. That this ordinance shall be in full force and effect from
and after its passage, approval and publication in the manner provided by
law. This ordinance shall be published in pamphlet form by authority of
the City Council.
