HomeMy WebLinkAboutG-1595 Ordinance No. G-1595 AN ORDINANCE AMENDING THE OFF-STREET LOADING AND OFF-STREET PARKING PROVISIONS OF THE ELGIN ZONING ORDINANCE. WHEREAS a written application has been made to amend the provisions of the Elgin Zoning Ordinance relating to off-street loading and off-street parking; and WHEREAS the Plan Commission has considered said proposed amendments and reported its findings and recommendations; and WHEREAS the Zoning Board of Appeals after due notice has conducted a public hearing in accordance with the applicable provisions of the statutes of the State of Illinois and the Elgin Zoning Ordinance; and WHEREAS the Zoning Board of Appeals has reported its findings and recommendations to the City Council. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Subsection B of Section 21-110 of the Elgin Zoning Ordinance be and is hereby amended as follows: (a) Sub-paragraph (3) entitled "FLOOR AREA AND EXEMPTIONS" is hereby deleted. (b) Sub-paragraph (4) , (5), (6) , (7) , (8), (9) , (10), (11), (12) and (13) are hereby renumbered and redesignated as sub-paragraphs (3) through (12), respectively. (c) That redesignated and renumbered sub-paragraph (8) entitled "IN YARDS" is hereby amended to read as follows: "(8) IN YARDS. Off-street parking spaces may be located in yards except within an eight (8) foot setback required for front yards, subject to the express provision that R-1 and R-2, Single Family Residence Districts and R-3, Two Family Residence Districts, one required space may be located on an improved concrete or asphault area approved by the City Engineer, within the required front yard or side yard adjoining the street setback." (d) That redesignated and renumbered sub-paragraph (9) entitled "DESIGN AND MAINTENANCE" is hereby amended by deleting the words "a. OPEN AND ENCLOSED PARKING SPACES." (e) That redesignated and renumbered sub-paragraph (10) is hereby amended to read as follows: "(10) SURFACING. All open off-street parking areas except parking spaces accessory to a single family or two-family dwelling shall be improved with a concrete, macadam base, or equal and surfaced with asphaltic concrete, comparable all-weather dustless material. Any addi- tional spaces added to the existing parking area shall be so graded and drained as to dispose of all water. In no case shall drainage be allowed across sidewalks. In the case of a parking area for more than fifteen (15) cars, all surface water shall be discharged directly into an adequate storm sewer or other approved drainage system. Surfacing and drainage shall be subject to approval by the Depart- ment of Public Works and Engineering." (f) Redesignated and renumbered sub-paragraph (11) is hereby amended to read as follows: "(11) STRIPING AND MARKING. All parking lots containing four or more spaces shall be striped and marked in accordance with the All Department of Public Works and Engineering specifica- tions." (g) Redesignated and renumbered sub-paragraph (12) is hereby amended to read as follows: "(12) PLANTING STRIPS. Planting strips shall be required on each side of any parking area which abuts upon or faces across a street, alley or place. The interior boundary of said planting strip shall be defined with a six (6) inch concrete curbing or other curbing material approved by the Department of Public Works and Engineering. The curbing shall be placed a minimum of eight (8) feet inside lot lines adjoining any street and a minimum of six (6) feet inside lot lines adjoining any alley or place so that no vehicle parked within the confines of the parking area will in any manner project over said lot lines into the surrounding area. This planting strip shall be maintained free of litter and shall require replacement of all dead and unsightly plant material." All �P. (h) Redesignated and renumbered sub-paragraph (13) is hereby amended to read as follows: "(13) SCREENING AND LANDSCAPING. a. Existing trees shall be saved whenever possible, as determined by the Department of Community Development. b. At no time shall the required screening be permitted to constitute a traffic hazard. All plans are subject to review by the Department of Public Works and Engineering. c. For those parking areas containing four (4) or more spaces and providing a maximum of fifteen (15) spaces, except in R-1, R-2, and R-3 districts, trees of an approved type and measuring not less than six (6) feet in height and two (2) inch diameter shall be required within the planting strip. The number of trees required will be calculated by dividing the total parking area frontage which adjoins any street, alley, or place by fifty (50) feet, but shall require no less than two (2) trees. The remaining portion of any planting strip shall be planted with either compact hedging, or evergreens and/or filled in with a specified, suitable ground cover. d. For those parking areas that provide more than fifteen (15) spaces, trees shall be required as in the above described manner. Additional screening with densely planted, compact hedge or evergreens shall be required. Such screening material shall be maintained at a maturity height not less than three (3) feet, but shall not exceed four (4) feet. The required screening hedge along front lot lines may be waived for open sales lots in accordance with the Department of Community Development standards. If any parking area requires more than two (2) parking rows, the additional rows will be marked at each end with a curb island. This curb island shall contain a minimum of one (1) tree, as previously specified, and a suitable ground cover; or if a tree is not practical, some other type of planting material deemed appropriate by the Department of Community Development. One lighting standard may also be placed within the curb island. e. All open automobile parking areas containing four or more parking spaces, except in the R-1, R-2, and R-3 districts, shall be effectively screened on each side adjoining or fronting any property situated in a Residence District or any institutional premises, by a solid wall or tow fence no less than five (5) feet in height nor more than six (6) feet in height or by a densely planted, compact hedge or evergreens, as previously specified, no less than five (5) feet in height, or any combination thereof." (i) Sub-paragraph (14) entitled "REQUIRED SPACES" is hereby All redesignated and renumbered as sub-paragraph "(16)". (j) New sub-paragraph (14) is hereby added to read as follows: "(14) LIGHTING. Any lighting used to illuminate any required off-street parking area shall be so arranged as to direct the light away from adjoining premises and streets." (k) That the following sub-paragraph is hereby added: "(15) SIGNAGE. No sign of any kind other than one designating entrance or exit or conditions of use shall be maintained on or in conjunction with a parking area. Such signs shall not exceed four (4) feet in height and shall not exceed eight (8) square feet in area. There shall not be more than one such sign for each entrance or exit." Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.
