HomeMy WebLinkAboutG-1594 Ordinance No. G-1594 r AN ORDINANCE ESTABLISHING YARD SETBACK REQUIREMENTS IN CODMERCIAL DISTRICTS. WHEREAS an application for amendment to the Zoning Ordinance for the City of Elgin has been made to establish yard setback requirements in commercial districts; and WHEREAS the Plan Commission has reviewed the proposed amendments and made a written report of its findings and recommendations; and WHEREAS the Zoning Board of Appeals after due notice has conducted a public hearing in accordance with the statutes of the State of Illinois and the applicable provisions of the Elgin Zoning Ordinance and has made its findings and recommendations to the City Council. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Subsection 5a of Section 21-108 of the Elgin Zoning Ordinance be and is hereby amended to read as follows: "a. FRONT YARDS: (1) Not less than fifteen feet in depth, except where a front yard setback line has been established by existing buildings occupying 50 percent or more of the total frontage on one side e"' of the segment of a street located between two intersecting streets, such yard shall be equal to not less than the average front yard setback of such existing buildings, but on a segment of such street 100 feet or less in length located between lots containing buildings the front yard setback line need not be greater than the setback line of the adjacent existing buildings. (2) A side yard adjoining a street shall be considered as a front yard. (3) Where the extension of a front lot line coincides with a front lot line of a Residential District, a yard equal in depth to the minimum front yard, required by this Ordinance for such adjacent residential district shall be provided along such front lot line." "b. SIDE YARDS: (1) If an interior side yard is provided, it shall be not less than five (5) feet in width, except where a lot line coincides with a Residential District or an institutional premise. (2) Where a lot line coincides with a lot line in an adjacent Residence District or institutional premise, a yard shall be provided along such lot line. Such yard shall be not less than twenty (20) feet in depth and shall be effectively screened by a solid wall or fence, or a densely planted, compact hedge no less than five (5) feet nor more than six (6) feet in height, or any combination thereof." 7(a.) Section 2. That Subsection C (5) of Section 21-108 of the Elgin Zoning Ordinance be and is hereby amended to read as follows: "(5) YARDS. Front, side and rear yards need not be provided. If interior side yards are provided they shall be not less than five (5) feet in width." Section 3. That Subsection D (5) of Section 21-108 of the Elgin Zoning Ordinance be and is hereby amended to read as follows: "(5) YARDS. Regulations governing yards in the B-1 district shall apply." Section 4. That Subsection E (5) of Section 21-108 of the Elgin Zoning Ordinance be and is hereby amended to read as follows: "(5) YARDS. Regulations governing yards in the B-1 district shall apply." Section 5. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 6. That this ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. This ordinance shall be published in pamphlet form, W. E.
