AN ORDINANCE
AMENDING CHAPTER 21 OF THE CITY CODE OF ELGIN, ILLINOIS ENTITLED THE ZONING
ORDINANCE.
WHEREAS a written application has been filed to rezone certain property
located at 1103 Dundee Avenue, Elgin, Illinois from M-1, Limited Manufacturing
District, to B-3, Service Business District, and for a special use to permit
an open sales lot; and
WHEREAS due notice has been given and a public hearing held in accordance
with applicable statutes of the State of Illinois and the provisions of the Elgin
Zoning Ordinance; and
WHEREAS the Elgin Zoning Board of Appeals and the Elgin Plan Commission
have recommended that the petition be granted.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That Subsection B of Section 21-106 of Chapter 21 of the
City Code of Elgin, Illinois, as amended, be and the same is hereby further
amended by adding the following paragraph:
"That the boundaries hereinbefore described and laid out
in the 'Zoning District Map' , as amended, be and are hereby
altered by including in B-3, Service Business District, the
following described premises: Commencing at a point on the
Northerly right of way line of Congdon Avenue 150.0 feet East
of the Easterly right of way line of Dundee Avenue, thence
Northwesterly a distance of 79.0 feet, thence Westerly 19.98
feet, thence Northwesterly 19.56 feet, thence North 41.92 feet,
thence West 52.6 feet to the Easterly right of way line of
Dundee Avenue, thence Southwesterly a distance approximately
140.0 feet to the intersection of the Norhterly right of way of
Congdon Avenue with the Easterly right of way line of Dundee
Avenue, then Easterly along the Northerly right of way line of
Congdon Avenue a distance of 150.0 feet to the place of beginning
and excepting that portion dedicated to the State of Illinois for
right of way purposes, being located in the City of Elgin, County
of Kane, Illinois. (Commonly known as 1103 Dundee Avenue.)"
Section 2. That it finds that a special use for a used automobile sales
lot on the subject property for a limited period is necessary for the public
convenience in that it allows an interim use of otherwise unused property and
promotes the redevelopment of the entire block upon termination of existing
leases;
That it further finds that by limitation of driveways, landscaping,
improvement of parking area and controlled lighting the public health, safety
and welfare will be protected;
That no substantial injury to the value of other property in the neighbor-
hood will result in that the property otherwise vacant will be improved in
appearance and the special use shall terminate within two years.
Section 3. That a special use is hereby granted to permit the operation
of a used automobile sales lot subject to the following conditions:
1. The special use granted herein shall expire two years
from the date of this ordinance.
2. Planting strips eight feet in depth shall be installed along
lot lines facing Dundee and Congdon Avenues.
3. Planting four trees of a minimum diameter of two inches and
not less than eight feet in height along Congdon and Dundee.
4. Parking lot shall be surfaced and striped in accordance
with specifications of the City of Elgin.
5. Lighting shall be arranged to direct light away from
adjoining premises and streets.
6. Customer access and parking shall be restricted to the
common drive at the north end of the property between the existing
Shell lot and Elgin Motors Used Car Lot; six off-street parking
spaces for customer use shall be provided.
7. All curb cuts shall be closed off with the exception of
one which shall be restricted to use for display cars and customer
test driving and located along Congdon Avenue at the east end of
the subject property.
8. Only one pole mounted sign not to exceed 22 feet in height
and 80 square feet in sign surface area shall be permitted.
Section 4. That all ordinances or parts of ordinances in conflict with
the provisions of this ordinance are hereby repealed.
Section 5. That this ordinance shall be in full force and effect from
and after its passage in the manner provided by law and shall be published
in pamphlet form by authority of the City Council.
