HomeMy WebLinkAboutG-1573 Ordinance No. G-1573 AN ORDINANCE AMENDING CHAPTER 21 OF THE CITY CODE OF ELGIN, ILLINOIS, ELGIN ZONING ORDINANCE. WHEREAS, due notice was given and a public hearing was held pursuant to the applicable statutes of the State of Illinois and the provisions of the Elgin Zoning Ordinance on the petition of Design Collaborative Limited to rezone the property located at 257 Adams Street, Elgin, Illinois from R-2 to R-4 zoning classification, and WHEREAS, the Elgin Zoning Board of Appeals has recommended that said petition to rezone be granted. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That subsection B of Section 21-106 of Chapter 21 of the City Code of Elgin, Illinois as amended be and the same hereby is further amended by adding to it the following paragraph: "That the boundary herein before and described and laid out in the Zoning District Minutes as amended be and hereby are altered by excluding from R-2 single family residence district and including in R-4 general residence district the following: That part of the East half of elk Section 23, Township 41 North, Range 8 East of the 3rd Principal Meridian, described as follows: Commencing at a point on the South line of Adams Street, in the City of Elgin, 1898.0 feet East of the West line of the said East half of Section 23 for a point of beginning; thence South on a line parallel with the said West line of the East half of Section 23 (said line being also 98.0 feet East of and parallel with the East line of George L. Kirk's Subdivision, as recorded) a distance of 194.75 feet to the Northerly right of way line of State Route No. 5 according to the plat of dedication recorded May 29, 1947 as Document No. 581905; thence Easterly on said Northerly right of way line of Highway on a curve to the right and having a radius of 4603.44 feet a distance of 44.82 feet to a point; thence Easterly on said Northerly right of way line of Highway, on a straight line a distance of 255.4 feet to a point that lies 198.5 feet South of the South line of Adams Street, aforesaid, (as measured parallel to said West line of East half of Section 23) ; thence North on said parallel line; 198.5 feet to the said South line of Adams Street; thence West on the said South line of Adams Street, 299.7 feet to the point of beginning, in the City of Elgin, Kane County, Illinois, commonly known as 257 Adams Street, Elgin, Illinois." r 69 February 28, 1973 VOLUME XXXVIII Section 2. That in the event that construction of an apartment building as described by petitioner's is not commenced within six months of the passage of this ordinance the ordinance shall be null and void and of no force and effect. Al Section 3. That all ordinances and parts of ordinances in conflict with this ordinance are repealed. Section 4. That this ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law and shall be published in pamphlet form. W. E. Glink, City Clerk Ordinance Passed Amending the Elgin Zoning Ordinance as it Pertains to Recreational Buildings and Uses Councilwoman Pearsaul made a motion, seconded by Councilman Santanni to pass an ordinance amending the Elgin Zoning Ordinance as it pertains to Recreational Buildings and Uses, Yeas: Councilmen Bruneman, Doxey, Landis, Pearsaul, Santanni, Verbic and Mayor Rauschenberger. Nays: None.
