HomeMy WebLinkAboutG-1568 t Ordinance No. G-1568 AN ORDINANCE AMENDING THE CITY CODE OF ELGIN TO FORMALLY ESTABLISH AND CREATE A DEPARTMENT elow OF COMMUNITY DEVELOPMENT. WHEREAS, the City Manager has recommended to the City Council that for the purpose of formulating and planning for the orderly development and growth of the community, preparing, reviewing and making recommendations relative to the Official Plan of the City, and providing for the coordination of proper implementation of the plan through zoning control, inspection and enforcement of the municipal build- ing and housing codes and related functions there be established a combined depart- ment in the City Government responsible for all planning, zoning, inspection, housing and health activities rather than being administered as two independent departments and a division of a third department, and WHEREAS, the City Council concurs in such recommendation. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Code of Elgin be, and it hereby is, amended to provide for a Department of Community Development to be responsible for all planning zoning, inspection, housing and health matters, not assigned to another department, in the following manner: By adding the following additional Chapter to the City Code of Elgin, Illinois, to wit: eft CHAPTER 13.5 ARTICLE I DEPARTMENT OF COMMUNITY DEVELOPMENT 13.5 - 101 Establishment 13.5 - 104 Plan Commission 13.5 - 102 Director 13.5 - 105 Zoning Board of Appeals 13.5 - 103 Functions 13.5 - 106 Board of Health 13.5 - 101 Establishment. There is hereby created an administrative depart- ment of the City Government to be known as the Department of Community Development. This department shall consist of the Director of Community Development, all planners, inspectors, and such other officers and employees as may be provided by the City Council and such equipment and supplies assigned to the operation thereof. 13.5 - 102 Director of the Department of Community Development. There is hereby established the Office of the Director of Community Development who shall be the Chief Planner and who shall be the supervising officer of said Department and shall have charge of all property and employees thereof. He shall be appointed by the City Manager with the advice and consent of the Council. 13.5 - 103 Functions. The Director of Community Development shall be responsible and actively engaged in formulating and making recommendations for the orderly development and growth of the community, the Official Plan of the City, and the coordination of implementation, inspection and enforcement of the Plan and City Codes. He shall be responsible for all planning activities, including: (a) To meet and counsel with subdividers and developers relative to the City Plan and ordinances, in relation to their particular projects; (b) To review all plats of subdivision and annexation plats submitted to the City and make comment relative to the same; (c) To review all plats of subdivision which are submitted to the City to see that the same comply with the general provision of the Subdivision Ordinance and Zoning Ordinance of the City of Elgin; (d) To prepare studies, designs and plans as parts of the comprehensive Master Plan; (e) To prepare statistical data and base maps, charts and tables relative to the Official Plan; (f) To prepare technical reports on special planning programs; (g) To prepare sketches, tracings and other data for proposeii municipal projects; (h) To conduct land use studies and analyses of changes in land use; (i) To analyze and prepare summary reports on social, physical and popu- lation data and correlate such information with the Official Plan of the City. He shall be responsible and exercise general supervision over the City building, electrical and plumbing inspectors in the performance of the duties assigned to them by statute, or ordinance and any amendments thereof. He shall be responsible for the enforcement of all codes and ordinances in the City or any amendments thereof, relating to the protection of the public health, including the inspection of all housing of persons within the corporate limits, the existence of nuisances endangering the health, the care and handling of food, and all other matters pertaining to the public health. He shall be responsible for causing proceeding to be instituted necessary to abate any violations, nuisances or failure to comply related to the subjects administered by his department. 13.5 - 104 Plan Commission. The Director of Community Development shall attend all meetings of the Plan Commission; ensure all plans and recommendations of the Commission to be properly kept and he shall keep that body informed as to matters within its jurisdiction. 13.5 - 105 Zoning Board of Appeals. The Director of Community Development or designated zoning officer shall attend all meetings of the Zoning Board of Appeals, cause all records of zoning and various decisions of the Board to be properly filed and he shall have all matters requiring a public hearing and other matters within its jurisdiction to be brought to its attention. ek 13.5 - 106 Board of Health. The Director of Community Development or designated Health Officer shall attend all meetings of the Board of Health; listing all recommendations of the Board and bringing to the Board all problems relating to the public health of the community. Section 2. That Ordinance No. G-1242 entitled "an Ordinance Amending the City Code of Elgin to Formally Establish and Create a Department of Health and Housing", passed March 27, 1968, Ordinance No. G-1391 entitled "an Ordinance Amending the City Code of Elgin to Formally Establish and Provide for a Depart- ment of Municipal Planning", passed August 12, 1970, and that part of Ordinance No. G-1560 entitled "an Ordinance Amending the City Code of Elgin to Formally Establish and Create a Department of Public Works and Engineering, passed November 22, 1972, designating as a function the responsibility for the building electrical and plumbing inspectors, be, and the same is hereby repealed, and of no further force and effect. Section 3. That all portions of the City Code, or ordinances and parts thereof containing the words, "Supervisor of the Department of Health and Housing" shall be deleted and inserted in the lieu thereof the words, "Supervisor of the Office of Health and Housing". Section 4. That all ordinances and parts thereof inconsistent with or in conflict with any of the provisions of this ordinance be and the same hereby are repealed and of no further force and effect. f' Section 5. That this ordinance shall be in full force and effect from and after its passage as provided by law and shall be published in pamphlet form by authority of the City Council.
