Ordinance Passed Apportioning the Cost of the Construction of a

Mr. Aydt pointed out that this ordinance was mentioned during discussion and $C
Estates. The reimbursement ordinance is necessary as the Junior college
constructed the oversize utilities to handle the need for development to the 9

AN ORDINANCE
7AppORTIONING THE 'COST OF THE CONSTRUCTION OF A WATER DISTRIBUTION LINE
in THE PROPERTY BETWEEN SOUTH STREET ON THE NORTH.AND JUNIOR COLLEGE
d end CT N0. 509 ON THE SOUTH, WHO MAY ELECT TO HOOK ON AND UTILIZE SUCH
FACILITIES IN THE FUTURE.
WHEREAS, the Board of Junior College District No. 509 who is the
force owner of certain real estate in the southwest part of the city were with -
aw out adequate public water supply for the development they were constructing
£ the on such property and it was necessary to extend a water distribution main
across the property between South Street on the north and the Junior College
District No. 509 property on the South, and
WHEREAS, the owner of the aforementioned property required the water
main to be constructed and used at his property at no financial cost to
him as a requirement of dedicating Belmont Street in order that the water
main could be installed, and
WHEREAS, such water line extension was constructed at a cost of
58,147.70 of which the Junior College District No. 509 paid $37,240.38
d the City of Elgin contributed the amount of $20,907.32, and
J�WHEREAS, said water main extension now makes public water supply
available to other areas immediately adjoining said Junior College which
service was not available until the said extension, and
WHEREAS, the said parties desire to be protected to the extent that
ther immediate area in the future may be allowed to hook on to the
water line extension without reimbursing said parties for the fair
ortionate cost of the water line facilities as pertains to the re-
tive parcel being hooked on thereto, and
WHEREAS, the City of Elgin feels that the construction of such water
ties is of benefit to the entire community and to the general public,
, safety and welfare of the City of Elgin, and
of a WHEREAS, the City Engineer has determined that the immediate area
to be benefited by such water line extension consist of a total of approxi-
o ert mately 500 acres (including 100 acres owned by the Junior College but
on of Elgio excluding the Spartan Meadows Golf Course land owned by the City of Elgin)

to the SOUL Road on the south; McLean Boulevard on the east; and Randall Road on the

land benefited amounts to $65 per acre plus six per cent interest annually
commencing July 1, 1969.

NOW, THEREFORE, BE IT ORDAINED BY THE.CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:'
Section 1. That the City of 'Elgin shall not permit. any of the afore-
described real estate to be hooked.onto and connected to the water extension
which was constructed by Junior College District No. 509 and the City of
Elgin until any such individual hooking and connecting such property onto
said water extension main shall pay the City of Elgin a a= equal to $65.00
per acre plus six percent interest annually commencing July 1, 1969 owned
by the individual requesting such connection. All such hook =on charges shall
be computed upon the actual acreage owned by the individual seeking such hook.

The aforedescribed connection charge.pertains solely to the cost of
extending the water line across the property between South Street, on the

Section 2. Out of each $65.00 plus interest collected by the City,
such connection charges, the City shall immediately.pay the sum of $50.0.
