AN ORDINANCE
AMENDING CHAPTER 21 OF THE CITY CODE OF ELGIN, ILLINOIS,
ENTITLED "THE ELGIN ZONING ORDINANCE".
WHEREAS, a public hearing has been duly held pursuant
to the Statutes of the State of Illinois, and the provisions
of the Elgin Zoning Ordinance, and
WHEREAS, the Elgin Zoning Board of Appeals has trans-
mitted its recommendations to the City Council, all of which
have been duly considered, and
WHEREAS, the City Council has determined that certain
limitations and restrictions should be imposed upon this re-
zoning for the health, welfare and safety of the surrounding
area , as are hereinafter set out.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ELGIN, ILLINOIS :
Section 1. That Sub-Section B of Section 21-106 of
Chapter 21 of the City Code of Elgin, Illinois , as amended
be, and the same hereby is , amended by adding thereto,
the following paragraphs :
That the boundaries hereinbefore described and laid
out in the "Zoning District Map", as amended, be,
and they hereby are, altered by excluding from B-1,
Community Business District, and including in B-3,
Service Business District, the following described
premises , to-wit:
The Northerly 32 Rods of the Southerly 7 Rods of the
Westerly 165 feet of Lot 3 in Block 14 of P. J. Kim-
ball 's Jr. 3rd Addition to the City of Elgin, Kane
County, Illinois . (Located at 309 Cherry St. , behind
366 Dundee Ave.)
That this rezoning is granted for the purpose of
constructing a building for the storage of tires and
automotive accessories . That for the health and
safety of the area , the owners must appropriately
screen the building to protect the residential area
on Cherry Street, and further that the entrance to
Cherry Street shall be limited in use to passenger
motor vehicles and trucks not to exceed one-half ton
in capacity. That the owners shall also provide a
back gate which shall be closed and locked after the
hour of 6:00 p.m. every day except Sundays and holidays,
when it shall be closed for the full 24 hour period.
Section 2 , That subject to the limitations above set
out, all ordinances or parts thereof in conflict herewith be,
and the same hereby are, repealed and of no further force
and effect°
Section 3. That subject to the above limitations,
this ordinance shall be in full force and effect from and
after its passage as provided by law and shall be published
in pamphlet form by authority of the City Council.
