AN ORDINANCE
AMENDING CHAPTER 21 OF THE CITY CODE OF ELGIN , ILLINOIS ,
ENTITLED , "THE ELGIN ZONING ORDINANCE " .
WHEREAS , a public hearing has been duly held pursuant
to the Statutes of the State of Illinois , and the provisions
of the Elgin Zoning Ordinance , and
WHEREAS , the Elgin Zoning Board of Appeals has transmitted
its recommendations to the City Council , all of which have
been duly considered .
NOW , THEREFORE , BE IT ORDAINED BY THE COUNCIL OF
THE CITY OF ELGIN , ILLINOIS :
Section 1 . That Sub-Section B of Section 21- 106 of
Chapter 21 of the City Code of Elgin , Illinois , as amended ,
be , and the same hereby is , amended by adding thereto ,
the following paragraph :
That the boundaries hereinbefore described and laid
out in the "Zoning District Map" , as amended , be ,
and they hereby are , altered by excluding from
R-2 , Single Family Residence District and R-3 , Two
Family Residence District , and including in B-3 ,
Service Business District , the following described
premises :
The North four (4) rods of the West eight ( 8) rods
of Lot 6 of James H . and Fulton Gifford ' s Addition
to Elgin in the City of Elgin , Kane County , I1 linois
(Also known as 147 South Liberty Street , Elgin ,
Illinois ) .
The South Half ( except the west 79 feet of the north
half of the south half) of Lot 5 in James Davidson ' s
Addition to Elgin , in the City of Elgin , Kane County ,
Illinois , also known as 143 South Liberty Street ,
Elgin , Illinois .
That part of Lot 6 & 12 of James H . & Fulton Gifford ' s
Addition to Elgin described as follows : Beginning at
the Northeast corner of Lot 16 of A . C . Keller &
McGarity ' s Addition to Elgin , then Southerly along the
East line of said Lot 13 a distance of 93 . 0 feet to a
point on a line that is 132 . 0 feet North of and parallel
with the North line of Laurel Street ; thence Easterly
along said parallel line a distance of 250 . 0 feet ;
thence Northerly parallel with East line of Lot 13
a distance of 93 . 0 feet to a point on the North line
of Lot 12 ; thence Westerly along said North line of Lot 6 ;
a distance of 250 feet to the point of beginning .
Section 2 . That the change in classification of the
above described property to B-3 , General Service Business
District is granted and predicated upon the petitioner ' s
representation that he wished such classification so that
he could continue , expand and improve the existing non-
conforming use as a public garage for the repair and
service of motor vehicles on the premises , and that no
other use permitted in the B-3 Service Business District
would , at any time , be established on the described
premises , without a public hearing and before the Zoning
Board of Appeals of the City of Elgin , and approval by
Ordinance by the City Council ; the reclassification of
said property will not be effective until a proper
restrictive covenant executed by the owners of the
described real estate setting forth the foregoing terms
and conditions shall be placed on record in the Office of
the Recorder of Deeds of Kane County , Illinois .
Section 3 . That all ordinances or parts thereof in
conflict herewith be , and the same hereby are , repealed and
of no further force and effect .
Section 4 . That this ordinance shall be in full force
and effect from and after its passage as provided by law
and shall be published in pamphlet form by authority of
the City Council .
