AN ORDINANCE
AMENDING CHAPTER 21 OF THE CITY CODE OF ELGIN , ILLINOIS ,
ENTITLED "THE ELGIN ZONING ORDINANCE" .
WHEREAS , a public hearing has been duly held pursuant
to the Statutes of the State of Illinois , and the provisions
of the Elgin Zoning Ordinance , and
WHEREAS , the Elgin Zoning Board of Appeals has transmitted
its recommendations to the City Council , all of which have
been duly considered .
NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ELGIN , ILLINOIS :
Section 1 . That Sub-Section B of Section 21- 106 of
Chapter 21 of the City Code of Elgin , Illinois , as amended ,
be , and the same hereby is , amended by adding thereto ,
the following paragraph :
That the boundaries hereinbefore described and laid
out in the "Zoning District Map" , as amended , be ,
and they hereby are , altered by including in B-3 ,
Service Business District , the following described
premises :
A part of the East half of the Southwest quarter of
Section 10 , Township 41 North , Range 8 East of the
Third Principal Meridian , bounded as follows : .
Commencing on the West line of the Public Highway
(Commonly known as McLean Boulevard) , at a point
thirty rods one foot and six inches North of the
South line of said Section; thence West parallel with
the South line of the Section seventy-nine rods 12 1/2
feet , to the West line of the East half of said
Southwest quarter of Section Ten ; thence North on said
line twenty rods and one foot; thence East parallel
with said South line of the Section , seventy-nine rods
12 1/2 feet to said West line of the Highway ; thence
South on said line twenty rods and one foot to the place
of beginning ; Containing ten acres , in said Township of
Elgin , Kane County , Illinois .
Section 2 . That said territories hereinbefore described
be and they are hereby included in the B-3 , Service Business
District as set forth in the Elgin Zoning Ordinance ( Chapter
21 of the City Code of Elgin , Illinois ) as amended , expressly
subject to the following terms and conditions , to-wit :
( a) No residential or commercial uses shall be
permitted upon the subject property , without prior
approval of the City Council , other than the following
specific uses :
1 . The existing two single family residences may
continue as non-conforming uses in a B-3 Service
Business District , pursuant to the applicable
terms and conditions of the Elgin Zoning Ordinance .
2 . Greenhouse and Nursery Uses including a retail
store and garden and gift shop in conjunction therewith.
Section 3 . That all ordinances or parts thereof in
conflict herewith be , and the same hereby are , repealed and
of no further force and effect .
Section 4 . That this Ordinance shall be in full force
and effect from and after its passage as provided by law
and shall be published in pamphlet form by authority of the
City Council .
