G-1482 AN ORDINANCE AUTHORIZING A SPECIAL USE AS AN AUTOMOBILE SERVICE STATION , TO BE ESTABLISHED ON CERTAIN PROPERTY IN THE CITY OF ELGIN , PURSUANT TO THE PROVISIONS OF CHAPTER 21 OF THE CITY CODE OF ELGIN , ILLINOIS , ENTITLED "THE ELGIN ZONING ORDINANCE" . WHEREAS , the City Council has been requested to authorize a Special Use as an automobile service station upon certain property , hereinafter described , in the City of Elgin , and WHEREAS , said property is zoned B-3 , Service Business District , under the provisions of the Elgin Zoning Ordinance , and WHEREAS , a written report has been prepared and forwarded to the Zoning Board of Appeals and the City Council by the Plan Commission pertaining to this particular petition , and WHEREAS , a public hearing has been held by the Zoning Board of Appeals after due notice by publication , as provided by Statute , and its findings and recommendations have been reported to the City Council , and WHEREAS , the City Council has determined that such Special Use requested is necessary for the public convenience , can be designed , located and operated so that the public health , safety and welfare will be protected , and will not cause substantial injury to the value of the other property in the neighborhood in which it is located and , therefore , should be granted . NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN , ILLINOIS : Section 1 . That a Special Use as an automobile service station be , and the same hereby is , authorized pursuant to the provisions of Chapter 21 of the City Code of Elgin , Illinois , entitled "The Elgin Zoning Ordinance" on the following described real estate , to-wit: That part of the Southwest Quarter of Section 7 , Township 41 North , Range 9 , East of the Third Principal Meridian , described as follows : Beginning at the intersection of the center line of State Route No . 58 (Golf Road ) with the West right of way line of Patton Drive , as extended Northerly to the center line of State Route No . 58 (Golf Road ) , a distance of 183 feet to a point; thence South parallel with the West right of way line of Patton Drive , a distance of 200 feet to a point , thence West parallel with the center line of State Route No . 58 (Golf Road) a distance of 183 feet to a point , said point being located on the West right of way line of Patton Drive , thence North along the West right of way line of Patton Drive a distance of 200 feet to the point of beginning , all in the City of Elgin , Cook County , Illinois and subject to the rights of the public across the North 50 feet and the West 33 feet thereof. Section 2 . That the Special Use for a automobile service station upon the above described real estate is granted and authorized upon the following described conditions , to-wit : 1 . That prior to the issuance of a building permit , the entire East half of the right of way of Patton Drive , from Grand Avenue to State Route 58 (Summit Street) shall be properly dedicated for public street purposes . 2 . That prior to issuance of a building permit , all engineering plans and specifications shall be approved by the Department of Engineering and Inspection of the City of Elgin , and that the developer shall furnish the City of Elgin with Subdivision Performance Bond guaranteeing the construction of all off-site improvements . 3 . That appropriate screening and landscaping, as approved by the Department of Engineering and Inspection , shall be provided for the site . 4 . That the proposed station shall be constructed of exterior masonary materials similar to those to be used in the proposed W . R. M . N . office complex . 5 . That the developer and owner shall comply with all applicable ordinances or regulations of the City of Elgin , including those prohibiting the sale , storage or rental of trucks , trailers , campers or other recreational vehicles . 6 . That in the event that the automobile service station constructed on the premises should , at any time thereafter , become vacated , and not utilized for its intended use for a period exceeding 180 days , the real estate shall be cleared of all structures at the owner ' s expense , unless after a hearing before the Plan Commission an additional extension of this deadline is recommended and approved by the City Council . Section 3 . That all ordinances or parts thereof in conflict herewith be , and the same hereby are , repealed and of no further force and effect . Section 4. That this ordinance shall be in full force and effect from and after its passage as provided by law and shall be published in pamphlet form by authority of the City Council . t. tick+ W . E .
