AN ORDINANCE
AMENDING CHAPTER 21 OF THE CITY CODE OF ELGIN , ILLINOIS ENTITLED
" THE ELGIN ZONING ORDINANCE" AS PERTAINS TO OFF-STREET PARKING
REQUIREMENTS IN RESIDENTIAL AREAS .
WHEREAS , in the opinion of this Council , it is to the best
interest of the general public that the off-street parking
requirements for residential units in the City of Elgin be
increased , and
WHEREAS , a public hearing has been duly held pursuant to
the Statutes of the State of Illinois and the provisions of the
Elgin Zoning Ordinance , and
WHEREAS , the Elgin Zoning Board of Appeals has transmitted
its recommendations to the City Council , all of which have been
duly considered .
NOW , THEREFORE , BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF ELGIN , ILLINOIS :
Section 1 . That Sub-section B of Section 21-110 of Chapter 21
of the City Code of Elgin , Illinois , be , and the same hereby is ,
amended in the following manner , to-wit:
( a) By amending paragraph ( 2) entitled "LOCATION " ,
rft by amending the first sentence under sub-paragraph ( a) to
provide as follows :
"Parking spaces required for single or two-family units
shall be located in rear or side yards on the same lot
as the dwelling served , with the exception that one such
required space may be located on an improved ( concrete
or asphalt) area , within the required front yard set back"
( b) That paragraph ( 9 ) entitled " IN YARDS" is
amended to provide as follows , to-wit:
"Off-street parking spaces may be located in yards ,
except required front yards and side yards adjoining
the street; subject to the express provision that
in the R- 1 , and R-2 , Single Family Residence Districts
and R-3, Two Family Residence District , one required
space may be located on an improved ( concrete or asphalt)
area , approved by the City Engineer , within the required
front yard, or side yard adjoining the street , set back .
( c) That sub-paragraph ( 14) entitled " REQUIRED SPACES "
be and the same hereby is , amended, by deleting
sub-paragraphs ( a) , ( b) , ( c) , and ( d) thereof
in their entirety and inserting the following new
paragraphs in lieu thereof, to-wit :
a . SINGLE FAMILY DWELLINGS .
At least two parking spaces for each dwelling , plus one
additional parking space for each two roomers , or lodgers
accomodated .
b . TWO FAMILY DWELLINGS .
At least two parking spaces for each dwelling .
c . DWELLINGS - ATTACHED.
At least two parking spaces for each dwelling unit .
d . MULTIPLE FAMILY DWELLINGS .
At least two parking spaces per dwelling unit , including
efficiency units .
Section 2 . That all ordinances or parts thereof in conflict
herewith be , and the same hereby are , repealed and of no further
force and effect .
Section 3 . That this ordinance shall be in full force and
effect from and after its passage as provided by law , and shall
be published in pamphlet form by authority of the City Council .
