AN ORDINANCE
/w AMENDING CHAPTER 21 OF THE CITY CODE OF ELGIN , ILLINOIS, EN-
TITLED "THE ELGIN ZONING ORDINANCE" .
WHEREAS , a public hearing has been duly held pursuant to
statute of the State of Illinois and the provisions of the
Elgin Zoning Ordinance, and
WHEREAS , the Elgin Zoning. Board of Appeals has transmitted
its recommendations to the City Council , all of which have
been duly considered .
NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN , ILLINOIS :
Section 1 . That Sub-section B of Section 21-106 of
Chapter 21 of the City Code of Elgin , Illinois , as amended ,
be, and the same hereby is , amended by adding thereto the
following paragraph :
That the boundaries hereinbefore described and laid
out in the "Zoning District Map" , as amended, be ,
and they hereby are , altered and amended in the
following manner, to-wit:
By including in M-1 Limited Manufacturing District
the following described premises , to-wit :
e A part of Sections 33 and 34, Township 42 North ,
Range 8 East of the Third Principal Meridian ,
described as follows : Beginning at the Northwest
,corner of the Northeast quarter of the Southeast
quarter of Section 33, Township 42 North , Range 8
East of the Third Principal Meridian; thence South
0 degrees 29 minutes West along the West line of
said Northeast quarter; 1153 . 5 feet to the North
line of the Illinois State Toll Highway Commission
right-of-way; thence South 88 degrees 34 minutes
East along said right-of-way 2363 . 46 feet; thence
North 1 degree 26 minutes East 650. 0 feet; thence
South 88 degrees 34 minutes East 23 . 44 feet;
thence North 10 degrees 01 minutes East, 200.0 feet;
thence North 88 degrees 34 minutes West, 239. 86 feet;
thence North 1 degree 26 minutes East 334 . 15 feet to the
North line of the South half of said Section 34;

Beginning at a point on the West line of the North
West quarter of the South East quarter of Section 33 ,
a distance of 996.04 feet South of the North West
corner thereof ; thence South Easterly on a line
forming an angle of 74 degrees 46 minutes to the left
with the said West line , a distance of 604 .98 feet
to a point; thence Westerly on a line forming an
angle of 164 degrees 46 minutes to the right with
the last described line extended , a distance
of 344 . 93 feet to a point; thence North Easterly
on a line forming an angle of 105 degrees 14
minutes to the right with the last described
line extended , a distance of 24 , 61 feet to a
point; thence North Westerly on a line forming
an angle of 90 degrees 00 minutes to the left

Expressly providing , however, that the above described premises
shall be subject to the following specific restrictions and
conai ti ons , to-wit:
1 . No residential or commercial uses shall be permitted
upon the above described property other than the following
specific uses :
( a) Motel , including accessory uses such as restaurant
and beverage facilities and interior arcade type of shops
forming an integral part of such motel complex .
( b ) Offices and office buildings .
( c) Research facilities .
( d) Retail and wholesale sales of products manufactured
or assemblea on the premises .
Nothing in this restriction shall be construed to prohibit use
concerned with the operation of establishments for the manufacture ,
assembly , disassembly , fabricating , repairing , storing , cleaning ,
servicing , or testing of materials , goods or products , provided
operation of such use conforms with the applicable regulations and
performance standards as setforth in the present Elgin Zoning
Ordinance.
2 . The Owners and developer , their heirs , successors and
assigns will install and maintain a 100-foot wide buffer strip
of green belting on that portion of said territory which abuts
the boundary lines of Frontenac Subdivision residential lots ,
contiguous to the above described real estate , which green belt
strip will not be utilized for buildings , vehicle parking or
roads , provided that any road or roadway constructed adjacent
to the North boundary thereof may utilize said green belt area
as a shoulder and required right-of-way , so long as no portion
of the pavement or traveled portion of such road extends into
the green belt area .
3 . No access roads shall be permitted from the subject
property connecting into or through the Frontenac Subdivision .
4 . No exposed concrete block or common brick exterior wall
facing shall be permitted on any structure erected on the above
described premises .
5 . The set back requirements for buildings on said territory
shall be as follows :
Front yards not less than 50 feet in depth .
Siae yards not less than 25 feet in depth .

Section 2 . That all ordinances or parts thereof , in conflict
ew herewith , be , and the same hereby are , repealed and of no further
force and effect ,
Section 3 . That this ordinance shall be in full force
and effect from and after its passage as provided by law
and shall be published in pamphlet form by authority of the
City Council .

Ordinance Authorized Prohibiting Parking on the South and East Side
_ of Ash and on the North and West Side of Birch
The City Manager recommended that parking be prohibited on the south and east side
of Ash from Birch to Birch and on the north and west side of Birch from Ash to Ash
at the request of the Fire Department because they recently had difficulties maneu-
vering the aerial platform in this area . He presented a sketch of the area for
clarification and stated that a recommendation for the removal of parking on both
sides may be made at a later, date as there are unpaved parking areas all around,
Councilman Rauschenberger made a motion, seconded by Councilman Barber, authorizing
the Corporation Counsel to prepare the necessary ordinance and authorizing the City
Manager to notify area residents , Yeas Councilmen Barber, Rauschenberger, Tillery
and Mayor Aift , Nays, None ,
Fried land's Subdivision Approved
The Plan Commission unanimously recommended approval of this one-lot subdivision,
The Friedland's are presently constructing a twelve unit apartment building on Wing
Street near the Tyler Creek Bridge. A verbal agreement was reached which required
the submission of a subdivision plat indicating a 33 ' right-of-way which will be
necessary when the roadway and bridge are improved in this area . A bond has also
been posted to assure the construction of curbs, getters and sidewalks in the area .
Councilman Rauschenberger said he was of the opinion that the Council previously de-
cided that the construction of sidewalk was impossible in this area and further that
r Ladd Construction Company would provide walkways through their Planned Unit Develop-
ment. He also stated that there is a cost of $45.00 per year involved for the bond.
The Corporation Counsel stated that no costs are involved if a property owners bond
is posted. The City Manager indicated that a list of areas where sidewalk is exempt
