rm. AN ORDINANCE
VACATING A PORTION OF OW AS CO AVENUE AND E THELW YNE STREET
IN SADLER'S; ADDITION TO THE CITY OF ELGIN, KANE COUNTY,
ILLINOIS.
WHEREAS, certain portionf of OFvasco) Avenue and Ethelwyne Street,
both public streets platted in part/Sadler's Addition to the City of Elgin, Kane
County, Illinois, have never been improved, maintained or used for street
purposes, and
WHEREAS, the public interest will be subserved by the vacation of
the following described portion of said public streets, to-wit:
That part of OsAvasco Avenue lying Easterly of the Easterly
line of North State Street, extended Northerly, and lying
Westerly of the Westerly right-of-way line of the
Chicago, Milwaukee, St. Paul and Pacific Railroad.
Also: That part of Ethelwyne Street lying Northerly of the
Northerly line of Frazier Avenue, extended Easterly, and
lying Southerly of the South line of Owasco Avenue, ex-
tended Easterly, all in Sadler's Addition in the City of Elgin,
Kane County, Illinois.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ELGIN, ILLINOIS:
Section 1. That the following described portions of certain public
streets, as platted and located in Sadler's Addition in the City of Elgin, Kane
County, Illinois, to-wit:
That part of Owasco Avenue lying Easterly of the Easterly
line of North State Street, extended Northerly, and lying
Westerly of the Westerly right-of-way line of the
Chicago, Milwaukee, St. Paul and Pacific Railroad.
Also: That part of Ethelwyne Street lying Northerly of the
Northerly line of Frazier Avenue, extended Easterly, and
lying Southerly of the South line of Owasco Avenue, ex-
tended Easterly, all in Sadler's Addition in the City of Elgin,
Kane County, Illinois.
be, and the same hereby are, vacated for street purposes.
Section 2. That the City of Elgin does hereby reserve to itself and
to any and all public utility companies owning any public service facilities
in any parts of said public streets vacated by this ordinance, full right of
ingress and egress in and from said street and an easement to go upon all
or any part of said streets vacated by this ordinance for the purpose of con-
tinuing, maintaining, reconstructing or extending any such public service
facilities which might be located thereon.
Section 3. That a certified copy of this ordinance, together with
a plat of the portion of said public streets• vacated, be filed -With the ..
Recorder of Deeds of Kane County, Illinois.
Section 4. That this ordinance shall be effective from and after its
passage, as provided by law, and shall be published in pamphlet form by
authority of the City Council.
