HomeMy WebLinkAboutS-873 Ordinance No. S-872 AN ORDINANCE ANNEXING CERTAIN TERRITORIES IN ELGIN TOWNSHIP, KANE COUNTY, ILLINOIS, TO THE CITY OF ELGIN, ILLINOIS, WHEREAS, a petition signed by all of the owners of record of the territories hereinafter described has been filed with the City Clerk and no electors reside on said territories, and WHEREAS, said territories are not within the corporate limits of any municipality and are contiguous to the City of Elgin, Illinois, and WHEREAS, said petition requests the annexation of such territories to the City of Elgin, Illinois, and contains therein a statement under oath that all of the owners of record of all land within such territories have joined in such petition and that no electors reside thereon, and WHEREAS, said petition requests that said property be zoned R-2 Single Family Re sidence District except that Lots 16 through 23, both inclusive, of Block 13 of Andresen Bros. Eagle Heights Unit No. 6, be classified as R-4 General Residence District and that Lot 7 in Block 15 and Lots 4 through 8, both inclusive, in Block 17 of Andresen Bros. Eagle Heights Unit No. 6, be classified as R-3 Two Family Residence District, as set forth in the Elgin Zoning Ordinance (Chapter 21 of the City Code of Elgin, Illinois), as amended, and WHEREAS, the matter of zoning was referred to the Zoning Board of Appeals of the City of Elgin to j ublish notice and conduct the necessary public hearing, all as in the statute made and provided, and WHEREAS, the Zoning Board of Appeals of the City of Elgin has duly advertised and held a public hearing pertaining to the zoning of said property, and has recommended that Lots 16 through 23, both inclusive, of Block 13 of Andresen Bros. Eagle Heights Unit No. 6 be classified as R-4 General Residence District, and that Lot 7 in Block 15 and Lots 4 through 8, both inclusive, in Block 17 of Andresen Bros. Eagle Heights Unit No. 6 be classified as R-3 Two Family Residence District under the Elgin Zoning Ordinance, as amended, and WHEREAS, the Plan Commission for the City of Elgin has recomm- ended to the City Council that the properties in this annexation petition be zoned in the manner requested by the petitioner, and WHEREAS, the City Council of the City of Elgin concurs in all of such recommendations made by the Zoning Board of Appeals and the Plan Commission of the City of Elgin. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the territories and lands described as follows, to- wit: That part of the Northeast quarter of Section 9, Township 41 North, Range 9 East of the Third Principal Meridian des-. cribed as follows: Beginning at the Northwest corner of Lot 15, in Block 13 of Andresen Bros, Eagle Heights, Unit No. 3, being a subdivision of part of the Northeast quarter of Section 9, and part of the Northwest quarter of Section 10, Township and Range aforesaid, being also a point on the Southerly right of way line of the Chicago and Northwestern Railway; thence Southerly, along the Westerly line of said Lot 15, a distance of 159. 85 feet to the Southwest corner thereof; thence Southerly, along a line which forms an angle of 12 degrees 02 minutes to the left with the prolongation of the last described course, a distance of 67. 44 feet to the Northwest corner of Lot 6 in Block 16 of said Andresen Bros. Eagle Heights, Unit No. 3; thence Southerly, along the Westerly line of said Lot 6, a distance of 130. 0 feet to the Southwest corner thereof, being also the Northwesterly corner of Lot 15 in Block 15 of Andresen Bros. Eagle Heights Unit No. 5, being a subdivision of part of the North- east quarter of Section 9 and part of the Northwest quarter of Section 10, Township and Range aforesaid; thence South- westerly,-,along the Northwesterly line of said Lot 15, a distance of 78. 13 feet to the Southwesterly corner thereof, being also the Northwesterly corner of Lot 14 in Block 16 of said Andresen Bros. Eagle Heights Unit No. 5; thence Southwesterly, along the Northwesterly line of said Lot 14, and along the Northwesterly line of Lot 13 in Block 15, of said Andresen Bros. Eagle Heights Unit No. 5, a distance of 170. 0 feet, to the Southwesterly corner of said Lot 13; being also the Northeasterly corner of Lot 11, in Block 15, of said Andresen Bros, Eagle Heights, Unit No. 5; thence Northwesterly along the Northeasterly line of said Lot 11, said Northeasterly line, extended Northwesterly and along the Northeasterly line of Lot 1 in Block 17 of said Andresen Bros. Eagle Heights, Unit No. 5, a distance of 324. 0 feet to the Northwesterly corner of said Lot 1; thence Southwesterly, along the Northwesterly line of said Lot 1, a distance of 85. 0 feet to the Southwesterly corner thereof, being also a point on the Northeasterly line of Kevin Avenue, as platted in said Andresen Bros. Eagle Heights, Unit No. 5; thence Northwesterly along the Northeasterly line of Kevin Avenue a distance of 118. 65 feet to a point on the Northwesterly line, extended Northeasterly, of Lot 25 in Block 16 of said Andresen Bros. Eagle Heights Unit No. 5; thence South- westerly along the Northwesterly line, extended Northeasterly and_along the Northwesterly line of said Lot 25, a distance of 238. 44 feet to the Southwesterly corner thereof; thence Northwesterly, along the Southwesterly line, extended • Northwesterly, of said Lot 25, a distance of 54. 08 feet; thence Northwesterly along a line which forms an angle of 0 degrees 45 minutes to the right with the prolongation of the last described course, a distance of 90. 52 feet; thence Northeasterly along a line which forms an angle of 76 degrees 37 minutes to the right with the prolongation of the last described course, a distance of 720. 42 feet to the South- erly right of way line of the Chicago and Northwestern Railway; thence Southeasterly, along said Southerly right of way line, a distance of 675. 58 feet to the place of beg- inning. Being situated in Elgin Township, Kane County, Illinois, and containing 9. 393 Acres more or less. Eagle Heights, Unit No. 5, being a subdivi- sion of part of Sections 9 and 10, as aforesaid; thence Easterly along said Southerly line extended Westerly and along said Southerly line, a distance of 204. 0 feet; thence Southerly along the Westerly line of Lot 8 in Block 11 of Andresen Bros. Eagle Heights Unit No. 4, as aforesaid, a distance of 79. 39 feet to an angle in the Westerly line of said Lot 8; thence Southerly along the Westerly line of Lots 8, 7 and 6 in said Block 11, a distance of 165. 0 feet to an angle in the West- erly line of said Lot 6; thence Southwesterly, along the Westerly line of Lots 6, 5, 4, 3 and 2 in said Block 11, a distance of 336. 65 feet to an angle in the Westerly line of said Lots 2 and 1 in said Block 11, a distance of 180. 0 feet tow to the place of beginning. Being situated in Elgin Township, Kane County, Illinois, and containing 5. 080 Acres more or less. be and they hereby are annexed to and made a part of the City of Elgin, a Illinois, and that the boundary lines of the City of Elgin be and they are hereby enlarged and extended to include within the corporate boundaries thereof the said described territories. Section 2. That the territory hereinbefore described be and it hereby is includedin the R-2 Single Family Residence District, as set forth in the Elgin Zoning Ordinance (Chapter 21 of the City Code of Elgin, Illinois) as amended, except that that portion of said territories which has been platted and subdivided as Lots 16 through 23, both inclusive, of Block 13 of Andresen Bros. Eagle Heights Unit No. 6, be classified as R-4 General Residence District and that portion of said territories platted and subdivided as Lot 7 in Block 15 and Lots 4 through 8, both inclusive, in Block 17 of Andresen Bros. Eagle Heights Unit No. 6, be classified as R-3, Two Family Residence District, as set forth in the Elgin Zoning Ordinance, (Chapter 21 of the City Code of Elgin, Illinois) as amended. Section 3. That accertified copy of this ordinance, together with an accurate map of the said annexed territory, be filed with the Recorder of Deeds of Kane County, Illinois. Section 4. That this ordinance shall be in full force and effect upon its passage as provided by law and shall be published in pamphlet form by authority of the City Council. E. C.
