r AN ORDINANCE
VACATING A PORTION OF A PUBLIC ALLEY IN COUNTY CLERK'S SUB-
DIVISION OF P. J. KIMBALL, JR. '5 SEpOND ADDITION TO THE CITY OF
ELGIN, KANE COUNTY,, ILLINOIS.
WHEREAS, a certain portion of the public alley platted in County
Clerk's Subdivision of P. J. Kimball, Jr. 's SecondAddition in the City of
Elgin has never been improved, maintained or used for street or alley
purposes, and
WHEREAS, the public interest will be subserved by the vacation of the
following described portion of said public alley, to-wit:
A 16. 5 foot wide strip of land described as follows: Comm-

encing at the intersection of the Southerly line of Kimball
Street with the Easterly line of Brook Street; thence Southerly
along said Easterly line of Brook Street, a distance of 132. 0
feet for a place of beginning; thence continuing Southerly along
said Easterly line a distance of 16. 5 feet; thence Easterly
parallel with the Southerly line of Kimball Street, a distance
of 113. 78 feet to the Easterly line of Chicago and North-
western Railway; thence Northwesterly, along said Easterly
line of Chicago and Northwestern Railway, a distance of 20. 28
feet; thence Westerly parallel withthe Southerly line of Kimball
Street, a distance of 102. 0 feet to the place of beginning.
Begin situated in the City of Elgin, Kane County, Illinois.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ELGIN, ILLINOIS:
Section 1. That the following described portion of a certain public
alley, as platted and located in County Clerk's Subdivision of P. J. Kimball,
Jr. 's Second Addition in the City of Elgin, Kane County, Illinois, to-wit:
A 16. 5 foot wide strip of land described as follows: Comm-
encing at the intersection of the Southerly line of Kimball
Street with the Easterly line of Brook Street, thence Southerly
along said Easterly line of Brook Street, a distance of 132. 0
feet for a place of beginning; thence continuing Southerly along
said Easterly line a distance of 16. 5 feet; thence Easterly
parallel with the Southerly line of Kimball Street, a distance
of 113. 78 feet to the Easterly line of Chicago and North-
western Railway; thence Northwesterly, along said Easterly
line of Chicago and Northwestern Railway, a distance of 20. 28
feet; thence Westerly parallel with the Southerly line of Kimball
Street, a distance of 102. 0 feet to the place of beginning. Being
situated in the City of Elgin, Kane County, Illinois.
be, and the same hereby is, vacated for street purposes.
Section 2. That the City of Elgin does hereby reserve to itself and to
any and all public utility companies owning any public service facilities in
any parts of said alley vacated by this ordinance, full right of ingress and
egress in and from said alley and an easement to go upon all or any part of
said alley vacated by this ordinance for the purpose of continuing, main-
taining, reconstructing or extending any such public service facilities
which might be located thereon..
Section 3. That a certified copy of this ordinance, together with a
plat of the portion of said public alley vacated, be filed with the Recorder
of Deeds of Kane County, Illinois.
Section 4. This ordinance shall be effective from and after its pass-
age, as provided by law, and shall be published in pamphlet form by
authority of the City Council.
