HomeMy WebLinkAboutS-867 Ordinance No. S-867 AN ORDINANCE VACATING A PORTION OF A PUBLIC ALLEY IN PART OF J. T. GIFFORD'S ADDITION AND F. L. McCLURE'S SUBDIVISION IN THE CITY OF ELGIN, KANE COUNTY, ILLINOIS. WHEREAS, a certain portion of the public alley platted in part of J. T. Gifford's Addition and F. L. McClure's Subdivision in the City of Elgin has never been improved, maintained or used for street or alley purposes, and, WHEREAS, the public interest will be subserved by the vacation of the following described portion of said public alley, to-wit: A 15 foot wide strip of land described as follows: Beginning at the Northeast corner of Lot 2 of F. L. McClure's Sub- division; thence Easterly along the North line of said Lot 2 extended Easterly a distance of 15 feet to the Northwest corner of Lot 2, Block 4 of J. T. Gifford's Addition; thence Southerly along the West line of said Lot 2 of J. T. Gifford's Addition, a distance of 100. 0 feet; thence Westerly, a dis- tance of 15 feet to the Southeast corner of Lot 2 of F. L. McClure's Subdivision; thence Northerly along the East line of said Lot 2 of F. L. McClure's Subdivision, a distance of 100. 0 feet to the place of beginning. Being situated in the City of Elgin, Kane County, Illinois NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the following described portion of a certain public alley, as platted and located in part of J. T. Gifford's Addition and F. L. McClure's Subdivision in the City of Elgin, Kane County, Illinois, to-wit: A 15 foot wide strip of land described as follows: Beginning at the Northeast corner of Lot 2 of F. L. McClure's Sub- division; thence Easterly along the North line of said Lot 2 extended gasterly a distance of 15 feet to the Northwest corner of Lot 2, Block 4 of J. T. Gifford's Addition; thence Southerly along the West line of said Lot 2 of J. T. Gifford's Addition;, a distance df'100. 0 feet; thence Westerly, a dis- tance of 15 feet to the Southeast corner of Lot 2 of F. L. McClure's Subdivision; thence Northerly along the East line of said Lot 2 of F. L. McClure's Subdivision, a distance of 100. 0 feet to the place of beginning. Being situated in the City of Elgin, Kane County, Illinois. be, and the same hereby is, vacated for street purposes. Section 2. That the City of Elgin does hereby reserve to itself and to any and all public utility companies owning any public service facilities in any parts of said alley vacated by this ordinance, full right of ingress and egress in and from said alley and an easement to go upon all or any part of said alley vacated by this ordinance for the purpose of continuing, main- taining, reconstructing or extending any such public service facilities which might be located thereon. Section 3. That a certified copy of this ordinance, together with a plat of the portion of said public alley vac,a'fed, 'be filed 'With-the Recorder of Deeds of Kane County, Illinois. Section 4. That this ordinance shall be effective from and after its passage, as provided by law, and shall be published in pamphlet form by authority of the City Council. E. C.
