HomeMy WebLinkAboutS-857 Ordinance No. S-857 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER TO JUNIOR COLLEGE DISTRICT NO. 509, COUNTIES OF KANE, COOK AND DUPAGE, STATE OF ILLINOIS, A DEED CONVEYING CERTAIN PROPERTY OWNED BY THE CITY OF ELGIN IN KANE COUNTY , ILLINOIS, TO JUNIOR COLLEGE DISTRICT NO. 509. WHEREAS, the City of Elgin is in the process of acquiring title from the State of Illinois to certain real property situated in Kane County, Illi- nois , adjacent to the City of Elgin, consisting of approximately 226. 283 acres , and WHEREAS, Junior College District No. 509, Counties of Kane, Cook and DuPage, State of Illinois , a body corporate and politic of the State of Illinois, has determined that it is necessary and proper to acquire a cer- tain portion of said real estate being purchased by the City of Elgin from the State of Illinois as a site for a Junior College, including buildings and appurtenant structures and land in Kane County, Illinois , which property is described as follows , to-wit: That part of the South half of Section 21 and part of Southwest quarter of Section 22; all in Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Comm- encing at the Southwest corner of the Northeast quarter of the Southwest quarter of said Section 21; thence Northerly along the West line of the Northeast quarter of the Southwest quarter of said Section 21, a distance of 624. 99 feet to a point on a line that is 30. 0 feet Southerly of (measured at right angles thereto) and parallel with the Northerly line of property now owned by the State of Illinois by Document No. 498148, for the place of beginning; thence Easterly, along said parallel line, a distance of 1523. 01 feet; thence Southeasterly along a curve to the right having a radius of 450. 0 feet and being tangent to the last described course, a distance of 486. 33 feet; thence South- easterly, tangent to the last described curve, a distance of 851. 20 feet; thence Southeasterly along a curve to the left having a radius of 875. 0 feet and being tangent to the last des - cribed course, a distance of 932. 73 feet; thence Easterly, tangent to the last described curve, a distance of 746. 22 feet; thence Northeasterly along a curve to the left having a radius of 750. 0 feet and being tangent to the last described course, a distance of 490. 84 feet; thence Northeasterly, tangent to the last described curve, a distance of 1287. 59 feet, thence North- "" easterly and Easterly along a curve to the right having a radius of 500. 0 feet and being tangent to the last described course, a distance of 405. 79 feet to a point on a line that is 30, 0 feet Southwesterly of (measured at right angles thereto) and A 126 April 20, 1967 VOLUME XXXII parallel with the Northeasterly line of lands conveyed by George D. Carbary as aforesaid; thence Northwesterly along said Northeasterly line, a distance of 356. 5 feet to the Easterly line of the State of Illinois property as aforesaid; thence Northeasterly along said Easterly line, being along a line that forms an angle of 89 degrees 28 minutes to the right with the prolongation of the last described course, a distance of 461 . 2 feet to the North line of said State of Illinois property; thence Westerly along said North line, a distance of 5779. 65 feet to the West line of the Northeast quarter of the Southwest quarter of said Section 21; thence Southerly along said West line, a distance of 30. 01 feet to the place of beginning. Kane County, Illinois, EXCEPTING THEREFROM that part lying Easterly of a line that is 100. 0 feet Westerly of and parallel with the center line of McLean Boulevard, Containing 99. 936 acres more or less . '1 HEREAS, the parties hereto have heretofore entered into a written agreement whereby the City of Elgin had agreed to take title to the real estate described in said House Bill 1868, approved August 10, 1965, and to convey the tract above described to said Junior College District No. 509, upon payment by the said Junior College District No. 509, to the City of Elgin of the proportionate cost of said tract being conveyed. NOW, THEREFORE, BE IT ORDAINED BY THE CITY CO UNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . Expressly subject, however, to the terms and conditions set forth in House Bill 1868, approved by the General Assembly on August 19, 1965, as sub- sequently amended. Section 2.
