AN ORDINANCE
DECLARING THAT IT IS NECESSARY FOR THE CITY OF ELGIN TO
ACQUIRE AND USE FOR CORPORATE PURPOSES CERTAIN PROPERTY
SITUATED IN THE CITY OF ELGIN, KANE COUNTY, ILLINOIS, OWNED
BY THE COUNTY BOARD OF SCHOOL TRUSTEES OF KANE COUNTY,
ILLINOIS, AND AUTHORIZING AND DIRECTING THE MAYOR AND CITY
CLERK TO EXECUTE AND DELIVER TO THE SAID COUNTY BOARD OF
SCHOOL TRUSTEES OF KANE COUNTY, ILLINOIS, A BODY POLITIC
AND CORPORATE OF THE STATE OF ILLINOIS FOR THE SOLE USE AND
BENEFIT OF SCHOOL DISTRICT NO. 46, A DEED CONVEYING CERTAIN
PROPERTY OWNED BY THE CITY OF ELGIN IN THE CITY OF ELGIN,
ILLINOIS, KNOWN AS THE "OLD ELGIN CEMETERY" AND ALSO A LEASE
OF CERTAIN OTHER MUNICIPAL PROF RTY IN EXCHANGE FOR PROPER
DEEDS OF CONVEYANCE TO THE CITY OF ELGIN OF SAID PROPERTY
PRESENTLY OWNED BY THE COUNTY BOARD OF SCHOOL TRUSTEES
OF KANE COUNTY, ILLINOIS.
WHEREAS, it is necessary and proper for the City of Elgin to acquire
and utilize for recreational and general municipal purposes the following
described property situated in the City of Elgin, to-wit:
That .: part of Supervisor Assessment Plat, County Clerk
Lots Number 346 thru 360 of the Southeast quarter of Section
24, Township 41 North, Range 8 East of the Third Principal
Meridian, described as follows: Beginning at the Northeast
corner of Lot 1, Block 1, Redeker Addition to Elgin, ALSO
being a point on the Southerly line of Hastings Street; thence
Easterly along said Southerly line of Hastings Street, a
distance of 554. 0 feet; thence Southerly a distance of 493. 0
feet to a point on the Northerly line of U. S. Route 20 By-
Pass that is 545. 0 feet Easterly of (measured along said
Northerly line) the Easterly line of Redeker Addition; thence
Westerly along said Northerly line of U. S. Route 20 By-Pass,
a distance of 545. 0 feet to the Easterly line of Redeker Addi-
tion; thence Northerly along said Easterly line of Redeker
Addition, a distance of 495. 0 feet to the place of beginning.
Being situated in the City of Elgin, Kane County, Illinois
and containing 6. 23 acres more or less.
hereinafter described as "School Board - Parcel 1", and
WHEREAS, it is necessary and proper for the City of Elgin to acquire
as a site for a West side fire station and other municipal purposes certain
property situated in the City of Elgin, Kane County, Illinois, described as
follows, to-wit:
That.part..of the Southwest Quarter of Section 15,

Meridian, described as follows: Commencing at the inter-
section of the East line of said Southwest quarter with the
Southerly line of U. S. Route 20 (Larkin Avenue); thence
Southwesterly along said Southerly line of Larkin Avenue, a
distance of 1000, 0 feet (for a place of beginning); thence
Southerly parallel with the East line of said Southwest quar-
ter, a distance of 134. 06 feet; thence Northeasterly para-
llel with said Southerly line of Larkin Avenue, a distance of
122. 73 feet; thence Northwesterly at right angles to the last
described course, a distance of 130. 0 feet to the Southerly
line of Larkin Avenue; thence Southwesterly along said
Southerly line of Larkin Avenue, being at right angles to
the last described course a distance of 90. 0 feet to the
place of beginning. Being situated in the City of Elgin,
Kane County, Illinois, and containing 0. 32 acres more or
less,
hereinafter described as "School Board - Parcel 2", and
WHEREAS, it is necessary and proper for the City of Elgin to acquire
as a location for a well and water pump, along with necessary ingress and
egress, the following described real estate, situated in the City of Elgin,
to-wit:
That part of the Southeast quarter of Section 16, Township
41 North, Range 8 East of the Third Principal Meridian,
described as follows: Commencing at the intersection of the
Westerly line of Airlite Street as platted in Country Knolls
Unit No, 8, being a subdivision of part of Sections 15 and
16, Township and Range aforesaid with a line that is 350. 0
feet Northerly of and parallel with the North line of
Walter G. McIntosh and Company's Fox River Farms;
thence Westerly along said parallel line, a distance of
704. 65 feet to the West line of the Southeast quarter of
said Section 16; thence Northerly along said West line, a
distance of :3.6.4, 91 feet for the place of beginning; thence
continuing Northerly along said West line, a distance of
12. 0 feet to the center of said Section 16; thence Easterly
along a line, if extended would intersect the most Northerly
corner of Lot 51 in Country Knolls Unit No. 8 as aforesaid
a distance of 12. 0 feet; thence Southerly parallel with the
West line of the Southeast quarter of said Section 16, a

westerly along a line that forms an angle of 60 degrees 40 minutes
40 seconds to the right with the prolongation of the last described
course, a distance of 396. 31 feet to a point on a line that is 12. 0
feet Southerly of and parallel with the Southerly line of Country
Knolls Unit No. 12, being a subdivision of part of said Section 16,
said point being 6. 0 feet Easterly of (measured along said parallel
line) the West line of the Southeast quarter of said Section 16, for
the terminous of the center line of said 10 foot wide easement,
Being situated in the City of Elgin, Kane County, Illinois.
hereinafter described as "School Board - Parcel 3" , and
WHEREAS, all of the three mentioned properties are presently owned by
the County Board of School Trustees of Kane County, Illinois, a body politic
and corporate of the State of Illinois, for the sole use and benefit of School
District No. 46, and
WHEREAS, the City of Elgin owns certain real estate in the City of Elgin
not presently needed or being used for municipal purposes of the City of Elgin,
legally described as follows, to-wit:
That part of the South half of Section 13, Township 41 North, Range 8
East of the Third Principal Meridian, described as follows: Beginning
at the intersection of the East line of Channing Street with the South
line of an alley 25 feet wide as shown on the plat of John Webb's Sub.
Div. of Lots 5, 6, 7 and 8 of Jas. T, Gifford's Addition and Out Lots
III and VII in the City of Elgin;thence East along the South line of
said alley and said line extended to the West line of Jas. Davidson's
Addition to Elgin; thence South along the West line of said Addition to
the North line of James H. and Fulton Gifford's Addition to Elgin;
thence West along the North line of said addition to the East line of
Channing Street; thence North along the East line of said Street to the
point of beginning, in the City of Elgin, Kane County, Illinois.
hereinafter described as "City - Parcel 1", and
WHEREAS, the City of Elgin owns or is in possession of, as a public
square, certain property in the City of Elgin, which is adjacent to ElginHigh
School and could more properly be maintained and developed as an open space
utilized by said high school, described as follows, to-wit:
That part of Lots 4 and 5 in Block 4 of J. T. Gifford's Addition
to Elgin and that part of the Southwest quarter of Section 13,
Township 41 North, Range 8 East of the Third Principal Meri-
dian, described as follows: The West 49. 5 feet of Lots 4 and 5
of Block 4 of J. T. Gifford's Addition as aforesaid, and the

'following described property: Beginning at the Northwest
corner of said Lot 4, Block 4 of J. T. Gifford's Addition; being
a point on the Southerly line of DuPage Street; thence Southerly
along the Westerly line of Lots 4 and 5 of said J. T. Gifford's
Addition, a distance of 264. 0 feet to the Southwest corner of Lot
5, being a point on the Northerly line of Fulton Street; thence
Westerly along said Northerly line of Fulton Street, a distance
of 198. 0 feet to the Easterly line of Chapel Street; thence
Northerly along said Easterly line of Chapel Street, a distance
of 264. 0 feet to the Southerly line of Du}Age Street; thence
Easterly along said Southerly line of DuPage Street, a distance
of 198. 0 feet to the place of beginning. Being situated in the
City of Elgin, Kane County, Illinois, and containing 1. 50 acres
more or less.

hereinafter described as "City - Parcel 2", and
WHEREAS, the County Board of School Trustees of Kane County,
Illinois, has determined that it is necessary and proper to acquire the prop-
erty described as City - Parcel 1 aforesaid, to be developed as a site for a
primary school situated in School District No. 46, and that it is necessary
and proper that they acquire a lease from the City of Elgin of the property
described as City - Parcel 2 aforesaid, to be utilized as an open space area
in conjunction with the operation of Elgin High School situated in School
District No. 46, and
WHEREAS, the City Council of the City of Elgin, Illinois, does hereby
determine that it is to the best interest of the general public that in consid-
eration of the County Board of School Trustees of Kane County, Illinois,
conveying to the City of Elgin for public use the aforedescribed tracts of
real estate owned by the County Board of School Trustees of Kane County,
Illinois, the City should convey and transfer the property described afore-
said as City - Parcel 1 to the said County Board of School Trustees of Kane
County, 'Illinois, for the sole use and benefit of School District No. 46, and
further should execute arid deliver to said County Board of School Trustees
of Kane County, Illinois, a lease for a term of tw-enty (20) ..ye4rs; of the
property described aforesaid as City - Parcel 2 for the sole use and benefit
of School District No. 46.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ELGIN, ILLINOIS:
Section 1, That upon the County Board of School Trustees of Kane
County, Illinois, a body politic and corporate of the State of Illinois, exe-
cuting and delivering to the City of Elgin proper deeds of conveyance,
supported with evidence of title satisfactory to the Corporation Counsel of

the City of Elgin, transferring title to the tracts of real estate hereinabove
described as "School Board - Parcel 1", "School Board - Parcel 2", and
"School Board - Parcel 3" to the City of Elgin, the Mayor and the City Clerk
of the City of Elgin are hereby authorized and directed to execute and del-

iver to the County Board of School Trustees of Kane County, Il.linois, the
following documents, to-wit:
(a) A Deed of Conveyance transferring title to the following described real
estate to the County Board of School Trustees of Kane County, Illinois, a
body politic and corporate of the State of Illinois, for the sole use and
benefit of School District No. 46, to-wit:
That part of the South half of Section 13, Township 41 North,
Range 8 East of the Third Principal Meridian, described as
follows: Beginning at the intersection of the East line of
Channing Street with the South line of an alley 25 feet wide as
shown on the plat of Tolin Webb's Sub. Div. of Lots 5, 6, 7
and 8 of Jas. T. Gifford's Addition and Out Lots III and VII
in the City of Elgin; thence East along the South line of said
alley and said line extended to the West line of Jas. Davidson's
Addition to Elgin; thence South along the West line of said
Addition to the North line of James H. and Fulton Gifford's
Addition to Elgin; thence West along the North line of said
Addition to the East line of Channing Street; thence North along
the East line of said street to the point of beginning, in the City
of Elgin, Kane County, Illinois,
expressly subject, however, to the following restrictions:
1. That said property shall be used only for public education and
recreation uses.
2. That only one principal building shall be constructed upon the
site,
3. That the school will either retain or relocate the present
tennis court facilities on said property for public recreational uses.
(b) A 20-year lease to said County Board of School Trustees of Kane County,
Illinois, a body politic and corporate of the State of Illinois, for the sole
use and benefit of School District No. 46 of the following described premises,
to-wit:
That part of Lots 4 and 5 in Block 4 of J. T. Gifford's Addi-
tion to Elgin and that part of the Southwest quarter of Section
13, Township 41 North, Range 8 East of the Third Principal
Meridian, described as follows: The West 49. 5 feet of Lots
4 and 5 in Block 4 of J. T. Gifford's Addition as aforesaid,
and the following described property: Beginning at the North-
west corner of said Lot 4, Block 4 of J. T, Gifford's Addi-
tion, being a point on the Southerly line of DuI ge Street;
thence Southerly along the Westerly line of Lots 4 and 5 of
said J. T. Gifford's Addition, a distance of 264. 0 feet to the
Southwest corner of Lot 5, being a point on the Northerly line

of Fulton Street; thence Westerly along said Northerly line
of Fulton Street, a distance of 198. 0 feet to the Easterly line

of Chapel Street; thence Northerly along said Easterly line
of Chapel Street, a distance of 264. 0 feet to the Southerly
line of DuI .ge Street; thence Easterly along said Southerly
line of DuPage Street, a distance of 198. 0 feet to the place
of beginning. Being situated in the City of Elgin, Kane
County, Illinois, and containing 1. 50 acres more or less.
providing that no buildings be constructed on said site and that said site
shall be dedicated for general educational and recreational and land-
scaping purposes.
Section 2. That this ordinance, when accepted in writing by the
County Board of School Trustees of Kane County, Illinois, shall be and
constitute a binding contract by and between the said County Board of
School Trustees of Kane County, Illinois, and the City of Elgin.
Section 3. That this ordinance shall be placed on file in the office
of the City Clerk for public inspection for at least 7 days prior to the
final passage thereof.
Section 4. That this ordinance shall be in full force and effect from
and after its passage as provided by law and shall be published in pamphlet
form by authority of the City Council.

Ordinance Passed Vacating Certain Streets in Civic Center Area
Councilman Barber made a motion, seconded by Councilman Santanni, to pass an
ordinance providing for the vacation of certain streets in the Civic Center area.
Yeas: Councilmen Alft, Barber, Santanni, and Tillery. Nays: None.
