AN ORDINANCE
PROVIDING FOR THE REINTERMENT OF ANY BODIES REMAINING IN
THE "OLD ELGIN CEMETERY", AND FURTHER PROVIDING THAT ANY
PERSON PROVING OWNERSHIP IN AND TO A LOT OR BURIAL SITE IN
SAID "OLD ELGIN CEMETERY" WILL, WITHOUT FURTHER CHARGE,
BE VESTED WITH OWNERSHIP OFA LIKE LOT OR BURIAL SITE IN THE
BLUFF CITY CEMETERY..
WHEREAS, the City of Elgin did, by Ordinance No. S-425, passed
November 13, 1945, vacate "Old Elgin Cemetery" for cemetery purposes,
and
WHEREAS, said cemetery had long been abandoned for cemetery
purposes prior to the passage of said Ordinance No. S-425, and
WHEREAS, all, or substantially all, of the bodies buried in said
"Old Elgin Cemetery" have been removed and reinterred in other ceme-
teries, and
WHEREAS, subsequent to November 13, 1945, said "Old Elgin
Cemetery"has been used by the City of Elgin and by the Board of Education
of School District No. U-46 for recreational purposes, and
WHEREAS, the City of Elgin and the Board of Education of School
District No. U-46 wish to cause the further development, utilization of said
premises known as "Old Elgin Cemetery" legally described as follows, to-wit:
That part of the South half of Section 13, Township 41 North,
Range 8 East of the 3rd Principal Meridian, described as
follows: Beginning at the intersection of the East line of
Channing Street with the South line of an alley 25 feet wide
as shown on the plat of John Webb's Sub. Div. of Lots 5, 6,
7 and 8 of Jas. T. Gifford's Addition and Out Lots III and
VII in the City of Elgin; thence East along the South line of
said alley and said line extended to the West line of Jas.
Davidson's Addition to Elgin; thence South along the West
line of said addition to the North line of James H. and
Fulton Gifford's Addition to Elgin; thence West along the
North line of said Addition to the East line of Channing Street
thence North along the East line of said Street to the point of
beginning, in the City of Elgin, Kane County, Illinois.
for educational and recreational purposes.
elk WHEREAS, the City of Elgin wishes to make provisions to reinter
any bodies which may presently be still buried upon said premises and to
compensate any person owning a lot and burial site thereon for the lost
of the same.
