S-823, PASSED ON APRIL 14, 1966, EN- TITLED "AN ORDINANCE ANNEXING CERTAIN TERRITORIES SITUATED IN ELGIN TOWNSHIP, KANE COUNTY, ILLINOIS, AND AUTHORIZING SPECIAL USE FOR THE DEVELOPMENT AND MAINTENANCE OF A PLANNED DEVELOPMENT FOR RESIDENTIAL PURPOSES TO BE ESTAB- LISHED THEREON". WHEREAS, Ordinance No. S-823, passed on April 14, 1966, entitled "An Ordinance annexing certain territories situated in Elgin Township, Kane County, Illinois, and authorizing special use for the development and main- tenance of a planned development for residential purposes to be established thereon", provided for the annexation of certain territories and lands des- cribed as follows, to-wit: That part of the East half of the Southwest quarter of Section 10, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Beginning at a point in the West line of McLean Boulevard, 370 feet North of the South line of said South- west quarter; thence West parallel with the South line of said quarter section, 262 feet; thence North to a point in the North line of the South 496. 5 feet of said Southwest quarter which is 266. 8 feet West of the West line of McLean Boulevard; thence West parallel with the South line of said quarter section to the West line of the East half of said Southwest quarter; thence South along said West line to a point 196. 3 feet North of the South line of said Quarter section; thence East parallel with the South line of said Southwest quarter to the West line of McLean Boulevard; thence North along said West line to the point of beginning (excepting that part dedicated to People of the State of Illinois by dedication dated September 15, 1934, and recorded August 12, 1935, in book 1008, page 183 as document no. 387751), in the Township of Elgin, Kane County, Illinois. to the City of Elgin, zoned as R-5, General Residence District, as set forth in the Elgin Zoning Ordinance (Chapter 21 of the City Code of Elgin, Illinois) as amended, with a special use for the operation and maintenance of a planned development, as defined therein, to be established thereon, and WHEREAS, the proper public hearing, as provided by statute, after due notice by publication, was held prior to the passage of said Ordinance, and WHEREAS, it was the intention of the parties and the City Council of the City of Elgin that approximately 0. 86 acres of the properties being annexed 1 . I by said Ordinance No. S-823, fronting on North McLean Boulevard in the r City of Elgin, should be classified as R-2, Single Family Residence District under the Elgin Zoning Ordinance, and WHEREAS, said acreage on North McLean Boulevard was inadver- tently included in the area classified R-5, General Residence District, with a special use permitted thereon for a planned development. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Ordinance No. S-823, passed by the City Council of Elgin, Illinois, on April 14, 1966, be, and the same hereby is, amended in the following manner, to-wit: By deleting from the properties indicated as included in the R-5, General Residence District, with a special use for the operation and maintenance of a planned development, as set forth in the Elgin Zoning Ordinance, (Chapter 21 of the City Code of Elgin, Illinois) as amended, and including in the R-2, Single Family. Residence District, as set forth in the Elgin Zoning Ordinance, (Chapter 21 of the City Code of Elgin, Illinois), as amended, the following described real estate, to-wit: That part of the East half of the Southwest quarter of Section 10, Township 41 North, Range 8 East of the Third Principal Meridian described as follows: Beginning at a point in the West line of McLean Boulevard that is 370 feet North of the South line of said Southwest quarter; thence Westerly parallel with the South line of said Southwest quarter, a distance of 305. 66 feet; thence Southerly at right angles to the last des- cribed course, a distance of 123. 61 feet; to a point on a line that is 50. 0 feet Northerly of (measured at right angles thereto) and parallel with the South line of said Southwest quarter; thence Easterly along said parallel line, a distance of 301. 63 feet to the West line of McLean Boulevard; thence Northerly along said West line, a distance of 123. 68 feet to the place of beginning. Being situated in the City of Elgin, Kane County, Illinois and containing 0. 86 acre more or less. Section 2. That Ordinance No. S-823, passed April 14, 1966, shall, in all respects, remain in full force and effect, as specifically modified hereby. Section 3. That this Ordinance shall be in full force and effect from and after its passage as provided by law and shall be published in f � • pamphlet form by authority of the City Council. Clyde L. Spiegler, City Clerk r • • Ordinance No. S-839 AN ORDINANCE AUTHORIZING MODIFICATION OF SIDEWALK ORDINANCE AS IT PER- TAINS TO A CERTAIN PORTION OF WASHBURN STREET, IN THE CITY OF ELGIN, ILLINOIS. WHEREAS, the property owners of certain•real estate fronting on .Washburn Street in the City of Elgin, known and described as 834 Washburn Street, have requested authorization of the modification of the Sidewalk .Ordinance as pertains to the portion of•W as hburn Street adjacent to their property, and WHEREAS, the City Council, after. reviewing the matter at length and observing :the. property, is of the opinion that the Sidewalk Ordinance should be modified, as pertains to said frontage, in order to avoid the destruction of existing trees. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: • Section 1. That a curb line sidewalk of approved specifications be, and such hereby is, authorized to be constructed upon and along the following street in the City of Elgin, Illinois, to-wit: Washburn Street, on the North side thereof, from the west edge of the e:isting driveway at 534 Washburn Street, west to Marguerite Street. • .Section 2. . That all ordinances or parts •thereof in conflict herewith be repealed and of no further;:fo.rr,:e and•effect. Section 3.
