Ordinance No. S-837 rift AN ORDINANCE ANNEXING CERTAIN TERRITORIES IN SECTIONS 3, 4, & 10, TOWNSHIP 41 NORTH, RANGE 8 EAST OF THE THIRD PRINCIPAL MERIDIAN, SITUATED IN ELGIN TOWNSHIP OF KANE COUNTY, ILLINOIS, TO THE CITY OF ELGIN, ILLINOIS. WHEREAS, the Petition, signed by all of the owners of record of the territories hereinafter,°described, has been filed with the City Clerk, and no electors reside on said territories, and WHEREAS, said territories are not within the corporate limits of any municipality and are contiguous to the City of Elgin, Illinois, and WHEREAS, said petition requests the annexation of said territories to the City of Elgin, Illinois, and contains therein a statement under oath that all of the owners of record of all land within such territories have joined in such petition, and that no electors reside thereon, and WHEREAS, such property is presently zoned for industrial and manu- facturing uses, all as designated in I District- Industry, as set forth in the zoning ordinance of Kane County, Illinois, and the petition requests that such territorie4, if annexed to the City of Elgin, be zoned M-1 Limited Manufacturing classification under the Elgin Zoning Ordinance, which class- ification will continue to permit the same or similar uses, as permissable under the I District - Industry classification of the zoning ordinance of Kane County, Illin©is, so as to conform with the present zoning within the county. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the territories and lands described as follows, to-wit: That part of Sections 3, 4 and 10, Township 41 North, Range 8, East of the Third Principal Meridian, described as follows: Commencing at the intersection of a line that is 40. 0 feet West of (measured at right angles thereto) and parallel with the center line of Crystal Lake Road (Sleepy Hollow Road) with the North right of way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad; thence South 89 degrees 19 minutes West along said North right of way line, a distance of 209. 99 feet for the place of beginning; thence "' continuing South 89 degrees 19 minutes West along said North right of way line, a distance of 1258. 89 feet to the Southerly line of Huntley Road (Big Timber Road); thence North 58 degrees 38 minutes West along said Southerly line, a distance of 919. 56 feet; thence North 14 degrees 09 min- utes East, a distance of 1700. 65 feet; thence South 89 degrees 33 minutes East, a distance of 1778. 77 feet to a point on a line that is 40. 0 feet West of (measured at right angles thereto) and parallel with the center line of Crystal Lake Road (Sleepy Hollow Road); thence South 1 degree, 38 minutes East along said parallel line, a distance of 1796. 99 feet; thence South 89 degrees 19 minutes West parallel with the North line of Big Timber Road, a distance of 209. 99 feet; thence South 1 degree 38 minutes East parallel with the centerline of Crystal Lake Road (Sleepy Hollow Road), a distance of 300. 0 feet to the place of beginning, being situated in Elgin Township, Kane County, Illinois. be, and they hereby are, annexed to, and made a part of, the City of Elgin, Illinois, and that the boundary lines of the City be, and they hereby are, enlarged and extended to include within the corporate bouib- daries thereof, the said described territories. Section 2. That the territories hereinbefore described,be,, and they hereby are, included in the M-1, Light Manufacturing District, as set forth in the Elgin Zoning Ordinance (Chapter 21 of the City Code of Elgin, Illinois) amended. Section 3. That a certified copy of this ordinance, together with an accurate map of the said annexed territory, be filed with the Recorder of Deeds of Kane County, Illinois. Section 4. That this ordinance shall be in full force and effect upon its passage, provided by law, and shall be published in pamphlet form by authority of the City Council. Clyde L. Spiegler, City Ciei PETITION FOR ANNEXATION TO THE MAYOR AND THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Now comes the petitioner, Northern Illinois Gas Company, a Corporation of Illinois, and respectfully submits this Petition to the Mayor and the City Council of the City of Elgin, Illinois, and states as follows: 1. That the petitioner herewith petitions that the following described property be annexed to the City of Elgin pursuant to the provisions of the Statutes of the State of Illinois in such case made and provided: That part of Sections 3, 4 and 10, Township 41 North, Range 8, East of the Third Principal Meridian, described as follows: • Commencing at the intersection of a line that is 10.0 feet West of (measured at right angles thereto) and parallel with the center line of Crystal Lake Road (Sleepy Hollow Road) with the North right of way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad; thence South 89 degrees 19 minutes West along said North right of way line, a distance of 209.99 feet for the place of beginning; thence continuing South 89 degrees 19 min- utes West along said North right of way line, a distance of 1258.89 feet to the Southerly line of Huntley Road (Big Timber Road); thence North 58 degrees 38 minutes West along said Southerly line, a distance of 919.56 feet; thence North lI degrees 09 minutes East, a distance of 1700.65 feet; thence South 89 degrees 33 minutes East, a distance of 1778.77 feet to a point on a line that is 110.0 feet West of (measured at right angles thereto) and parallel with the center line of - Crystal Lake Road (Sleepy Hollow Road); thence South 1 degree 38 minutes East along said parallel line, a distance of 1796.99 feet; thence South 89 degrees 19 minutes West parallel with the North line of Big Timber Road, a distance of 209.99 feet; thence South 1 degree 38 minutes East parallel with the center line of Crystal Lake Road (Sleepy Hollow Road), a distance of 300.0 feet to the place of beginning, being situated in Elgin Township, Kane County, Illinois. 2. That said territory is not within the corporate limits of any Municipality. 3. That said territory is contiguous to the City of Elgin, Illinois. 4. That there are no electors residing on said property. 5. That the petitioner is the owner of record of all of the land within the territory hereinabove described except the South half of Big Timber Road along that portion of said Road which angles in a Northwesterly direction from the Chicago, Milwaukee, St. Paul and Pacific Railroad right of way. r July 18, 1966 Mr. R. Grove Avenue Elgin, Illinois Dear Mr. Haldimant On several occasions you have indicated that the Northern Illinois Gas Company is interested in annexing its pro• party on the northwest corner of Sleepy Hollow Road and Big Timber Road to the City of Elgin. If the property is zoned for manufac- turing in Kane County, it can be annexed to the city as "M•1" Manufacturing without the necessity of petitioning the Elgin Zoning Board of Appeal for rezoning. The annexation petition would be submitted contingence on obtaining the requested zoning from the Elgin City Council. Recently, Century Oaks Subdivision, Units 6.10 was annexed to the City' of Elgin. At that time, it wee determined that Sleepy Hollow Road should have an 80 foot right.of-way in place of its present approximately 60 foot right-old-way. The 80 foot rightuof-way is standard for major arterial streets in all our subdivisions and other areas. This would mean that either now or when the industrial area is subdivided you would have to deed approximately 10 feet on the east edge of your property to the city for street purposes. At the present time there is a fence along your property line. If and when Sleepy Hollow Road is widened and it becomes necessary to relocate the fence, the City of Elgin would pay for relocation cost of the fence. If, however, the fence is relocated or removed for your convenience it would be your responsibility to pay this cost. I hope that this information answers your questions on annexation.
