TOWNSHIP 41 NORTH, RANGE 9, EAST OF THE THIRD PRINCIPAL MERIDIAN, IN HANOVER TOWNSHIP, COOK COUNTY, ILLINOIS, IN THE CITY OF ELGIN, COOK COUNTY, ILLINOIS. WHEREAS, a petition signed by all of the owners of record and elec- tors residing on the territories hereinafter described has been filed with the City Clerk, and WHEREAS, said territories are not within the corporate limits of any municipality and are contiguous to the City of Elgin, Illinois, and WHEREAS, said petition requests the annexation of such territories to the City of Elgin, Illinois, and contains therein a statement under oath that all of the ownersc,of record of all of the land within such territories and all of the electors residing thereon, have joined in such petition, and WHEREAS, said petition requests that in the event that said lands are annexed to the City of Elgin, that they be zoned M-1 Limited Manufacturing .District as set forth in the Elgin Zoning Ordinance (Chapter 21 of the City Code of Elgin, Illinois), as amended, and WHEREAS, the matter of zoning was referred to the Zoning Board of Appeals of the City of Elgin to publish notice and conduct the necessary pub- lic hearing, all as in the statute made and provided, and WHEREAS, the Zoning Board of Appeals of the City of Elgin has duly advertised and held a public hearing pertaining to the zoning of said prop- erty and has recommended that the said lands (excluding the Northerly 125' of said .prerniaes .lying East of the Elgin, Joliet and Eastern Railway Company right-of-way) be classified as M-1 Limited Manufacturing District and that the said Northerly 125' lying East of the. Elgin, Joliet and Eastern Railway Company right-of-way be classified as R-4 General Residence District as provided by the Elgin Zoning Ordinance as amended, and WHEREAS, the petitioners have consented to the said zoning class- ifications in the event that said territories are annexed to the City of Elgin, and WHEREAS, the City Council of the City of Elgin concurs with such rec- ommendations made by the Zoning Board of Appeals of the City of Elgin. the Southerly line of said parcel of land; thence Northwesterly along said Southerly line 109. 0 feet to an angle in said Southerly line; thence Southwesterly along said Southerly line 177. 4 feet; thence Southwesterly along said Southerly line being along a curve to the right having a radius of 272. 0 feet a distance of 332. 79 feet to the Southerly line of the Frontage Road; thence Northwesterly along said Southerly line 44. 11 feet to the place of beginning. EXCEPTION THEREFROM a strip of land 40. 0 feet wide lying East of and adjacent to the East line of lands conveyed to Public Service Company of Northern Illinois by Document No. 9542306 and lying South of the South line of Lot "C" and North of the North line of lands dedicated by Document No. 17993033. All of the above being situated in Hanover Township, Cook County, Illinois. be and they hereby are annexed to and made a part of the City of Elgin, Illinois and that the boundary lines of the City of Elgin be, and they hereby are, en- larged and extended to include within the corporate boundaries thereof the said described territories. Section 2. That all of said territories hereinbefore described exc.ludirxg the Northerly 125 feet of the above described premises lying East of the Elgin, Joliet and Eastern Railway Company right of way be, and they hereby are, included in the M-1 Limited Manufacturing District as set forth in the Elgin Zoning Ordinance (Chapter 21 of the City Code of Elgin, Illinois ) as amended. Section 3. That the Northerly 125 feet of the territories hereinbefore described, lying East of the Elgin, Joliet and Eastern Railway Company right of way be and they hereby are, included in the R-4 General Residence Dis- trict as set forth in the Elgin Zoning Ordinance (Chapter 21 of the City Code of Elgin, Illinois) as amended. Section 4. That no building permit shall be issued for any portion of said tract unless Petitioners, their successors or assigns shall cause binding restrictive covenants running with the land to be placed thereon in accord- ance with representations of Petitioners attached hereto and made a part hereof as Exhibit "A". Section 5. That a certified copy of this ordinance together with an accurate map of the said annexed territories be filed with the Recorder of Deeds of Cook County, Illinois. Section 6. That this ordinance shall be in full force and effect from and after its passage as provided by law and shall be published in pamphlet form r EXHIBIT "A" FORMING A PART OF ORDINANCE NO. 5-831 ITEMS FOR RESTRICTIVE COVENANTS: To control development as much as possible and also practical, we pro- pose the following restrictions in addition to the Elgin Ordinances. SETBACKS All buildings must be set back at least 75 feet from the center line of the front street. BUILDING TO LAND RATIO There must be at least a two to one ratio of total land to building area. PARKING LOTS Off street parking must be provided for all employees based on a minimum ratio of 350 square feet for every 1-1/2 employees. DESIGN All buildings erected on the property shall be of a masonry or steel construction with face of common brick or prefinished quality steel exterior. No cement block exterior construction will be allowed. The entire building or any addition thereto will be designed as a simple object not differing in usage of material on any exterior wall. Expandable walls may be rof a finished temporary material but must be finished with a like face material within five years from completion if not then expanded. All construction shall be submitted for approval by the grantor. LANDSCAPING The area between the building set back lines and the street shall be used for either open landscaping and green areas or for service access to the building, or to a parking lot, The remainder of the property excepting building, parking and storage areas shall be done attract- ively with lawns, trees, shrubs and similar treatment, shall be properly maintained in a well kept condition. STORAGE Storage yards for equipment, raw materials, semi-finished or finished products shall be so shielded by a fence, shrubs, hedges or other foliage as to effectively screen the view of such storage from surrounding highways and streets. LOT AREA The minimum lot area of the first row of building sites platted or sold on either side of the railroad right of way along the North por- tion of the annexed tract zoned M-1 Limited Manufacturing, shall be not less than 4-1/2 acres per individual lot.
