HomeMy WebLinkAboutS-819 Ordinance No. S-819 AN ORDINANCE ANNEXING CERTAIN TERRITORIES SITUATED IN HANOVER TOWNSHIP, COOK COUNTY, ILLINOIS, TO THE CITY OF ELGIN, COOK COUNTY, ILLINOIS. WHEREAS, a petition signed by all of the owners of record of the territories hereinafter described has been filed with the City Clerk and no electors reside thereon, and WHEREAS, said territories are not within the corporate limits of any municipality and are contiguou to the City of Elgin, Illinois, and WHEREAS, said petition requests the annexation of such territories to the City of Elgin, Illinois, and contains therein a statement under oath that all of the owners of record of all of the land within such territories have joined in such petition and that no electors reside thereon, and WHEREAS, said petition requests that in the event said lands are annexed to the City of Elgin, that they be zoned "B-3" Service Business District as set forth in the Elgin Zoning Ordinance (C hapter 21 of the City Code of Elgin, Illinois), as amended, and WHEREAS, the matter of zoning was referred to the Zoning Board of Appeals of the City of Elgin to publish notice and conduct the nece- ssary public hearing, all as in the statute made and provided, and WHEREAS, the Zoning Board of Appeals of the City of Elgin has duly advertised and held a public hearing pertaining to the zoning of said property and has recommended that the said lands be classified as "B-3" Service Business District, as provided by the Elgin Zoning Ordinance as amended, and WHEREAS, the City Council of the City of Elgin concurs in such recommendation made by the Zoning Board of Appeals for the City of Elgin. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the territories and lands described as follows: to-wit: That part of Sections 17 and 18 in Township 41, North, Range 9 East of the Third Principal Meridian described as follows: Commencing at the Northeast corner of said Section 19; thence South on the East line thereof 8. 95 chainp; thence South 63 degrees West 24 chains to the corner of what was known as the Burritt lands, thence North 3=1/2 degrees East 19. 26 chains to the North line of said Section 19; thence in the same direction 7. 68 chains on Section 18 aforesaid to the Highway leading to Elgin; thence following the center of said highway South 73=3/4 degrees East 8. 81 chains to the place of beginning; thence North 161/2 degrees East 4. 46 chains; thence South 733/4 degrees East 10. 60 chains to the East line of said Section 18; thence in the same direction on Section 17 aforesaid 5. 10 chains to L. Herrick's West line; thence South 3-1/2 degrees West 4. 57 chains to the center of highway aforesaid; thence along said highway North 733/4 degrees West 16. 486 chains to the place of beginning, situated in Hanover Township, Cook County, Illinois. be and they are hereby annexed to and made a part of the City of Elgin, Illinois, and thallthe boundary lines of the City of Elgin be and they are' 'hereby enlarged and extended to include within the corporate boundaries thereof the said described territories. Section 2. That said territories hereinbefore described be and they are hereby included in the "B-3" Service Business District as sit forth in the Elgin Zoning Ordinance (Caapter 21 of the City Code of Elgin, Illinois) as amended. Section 3. That a certified copy of this ordinance together with an accurate map of the said annexed territories be filed with the Recorder of Deeds of Kane County, Illinois. Section 4. That this ordinance shall be in full force, and effect from and after its passage as provided by law and shall be published in pamphlet form by authority of the City Council. Clyde L.
